J T Barrett's police citation with actual facts.
The most pertinent is his vehicle. He was driving a 2003 Chevy Trailblazer. No new Explorer with dealer tags. No story there.
The second is that he blew a .099. Not just barely above the .08 threshhold as given in the initial post here.

OSU is going to suspend him for one week, though, because he was only cited with a misdemeanor.
http://www.usatoday.com/story/sports/ncaaf/bigten/2015/10/31/ohio-state…
It wouldn't matter much if they suspended him for two weeks. The second game he'd miss would be Illinois, and OSU can beat the Illini easily enough with Jones at QB.
November 2nd, 2015 at 12:18 PM ^
I thought it was odd that he "only got one week because it was a misdemeanor". Which inherently implies (in my mind) that you must be cited a felony to get a two week suspension. Quite a big difference in the eyes of the law, but not in the eyes of the university.

One week for these type of violations is typical. It is also right in line with the punishments applied by other schools for the same offense.
And the loss of financial aid is also consistent with what Urban Meyer has done since at OSU. It is not loss of scholarship, just the financial aid (which I believe is the stipend they get to help with living expenses).
November 2nd, 2015 at 2:30 PM ^
doesn't lose his scholarship, but he does lose money that could be used to take summer courses. I guess I shouldn't pretend to understand all of the nuances of these arrangements, especially with the new stipends recently approved. Insert inappropriate money from boosters joke here...

Dammit. Once again, bullshit rumors are way more fun than the truth.
November 2nd, 2015 at 11:51 AM ^
I want OSU at their best when we beat them. Last thing I want is for them to have an excuse or for Meyer to end up leaving before Harbaugh gets the Michigan machine rolling. I'm still mad that Tressel was fired and we didn't get any revenge against him.
November 2nd, 2015 at 12:00 PM ^
No. Do not care whether they are at "their best." Only want to win. Circumstances be damned. For all I care Bosa, Elliott, Jones, and Barrett can all break their ankles during warm ups.
Win the game.
November 2nd, 2015 at 12:04 PM ^
Seriously. I don't see OSU and MSU fans discounting the last 10 years of dominance because Michigan "hans't been their best." Those rivalries are a zerosum game -- things that are good for them are bad for us, and vice versa.

November 2nd, 2015 at 12:38 PM ^
If you have been watching our offense, we are still not at our best, but with Harbaugh at the helm, we are a hell of a lot better than we were. The areas of need will be fixed soon enough.
November 2nd, 2015 at 5:18 PM ^
Do you think they care about excuses when they beat us? You think they care that the darkest days of a Michigan team when RR/Hoke were the coaches (and we had ONE win against them) would diminish their bragging rights on us?
FUCK THAT. Suspend their whole Offensive Line and the QB...beat the shit out of them and then laugh until next year.

I think the punishment should be that Barrett is suspended at the week of Michigan's choice. And that Hackett gets to give Smith a wedgie. Wow-wikipedia covers everything!

I don't expect Meyer to go all whup-ass on JT, then again...

My only regret is that I have but one neg to give to this post.

Maybe Meyer didn't, but I'd hope whoever slapped his wrist at the CPD is made to be an example. Well over the legal limit? Bah, get your buddy to take you home! I bet Steve Bellisari is pissed at his lack of preferential treatment...

From: http://dui.drivinglaws.org/ohio.php
If your blood alcohol concentration (BAC) was between .08%-.17% you will serve a mandatory 72 hours in jail. You will also be ordered to pay a fine between $250 and $1,000.
I guess that "mandatory" doesn't mean the same thing in Ohio as it does in the rest of the country.
November 2nd, 2015 at 11:21 AM ^
In Ohio, they're rather more like "guidelines", I would say; unless you have State of Michigan plates on your vehicle.
November 2nd, 2015 at 11:48 AM ^
Wasn't proud of this momemnt but I did make the awful decision to drink and drive. My dui charge was 30 days in Jail. However, I went to a shrink on a weekly basis to prove I wasn't alcohol dependent, then was able to get 27 of those 30 days suspended. I spent three days, at a DIP and had to meet with the MAAD team to regain the points on my license. My fines and lawyer fees were all around $5,000, lost my driving privileges for 6 months except for work and school. I was not suspended from school or lose my Internship. This was in Ohio too.

Are most of the people you know in Ohio addicted to heroin like they showed on 60 Minutes last night? What a disturbing story. I shouldn't be joking about that, but the photo that accompanied the story had a needle shooting up the state and it was centered right about over Columbus.
November 2nd, 2015 at 11:59 AM ^
for those to apply. Mandatory jail terms and fines for being charged with a crime seem a tad harsh.

my bad
November 2nd, 2015 at 12:47 PM ^
I don't know personally anybody in Ohio who was immediately jailed after getting a DUI. They usually cite you, give you your court date, and you're released to someone.
One of my roommates from college got one and I was worried about his drunk ass so I called the station. They said "Oh, the friendly black guy? Yeah, he's getting ready to be released. An officer will be dropping him off at home shortly."
November 2nd, 2015 at 5:09 PM ^
a friend of mine was sentenced to over 100 hours of jail for a drunk driving, but was able to work them off via community service.
the 'mandatory' may refer to sentencing once he's officially found guilty, and even then he might be able to work off the jail time. i suspect he hasn't paid any fines yet, either.

It doesn't mention the type of car he was driving anywhere in that article.

A couple of things jump out at me:
1. He's 20, so the legal limit is 0.02. He's not "just barely over the legal limit", he's technically 5 TIMES over the legal limit.
2. Shouldn't the legal limit for under 21 be 0? Are they accounting for all the times 20 year olds take Nyquil before jumping in the car or something?
3. Are there charges for being under 21 in this situation? Or do you have to actually be holding the alcohol?
November 2nd, 2015 at 11:22 AM ^
but it's a different and lesser charge than being over .08. That's not what he was cited for.
2. Zero is probably a bad limit for anything that you measure.
3. I think he does have to be found with alcohol for a MIP charge.

In Michigan your body can be the "container" (source: Judge Post)... not sure in Ohio.

I'm a prosecutor in Ohio. Underage Consumption under Ohio Revised Code section 4301.69(E) states "No underage person shall knowingly order, pay for, share the cost of, attempt to purchase, possess, or consume any beer or intoxicating liquor in any public or private place." So the mere act of consumption is sufficient for the Ohio charge. You don't have to be in possession of it. It is a Misdemeanor of the 1st Degree punishable up to 6 months in jail.

Or male infants undergoing a circumcision who are given a little Manischevitz-soaked napkin to suck on. I can't imagine that really dulls the pain, though.

In Ohio he can drink at home or on alcohol selling premises with his parents if they give consent, or for religious purposes, or for medicinal purposes.
