There might be a little difference on the living thing but painting something that represents an actual person is definitely iffy regardless. The Spartan statue is a lot less personal.
If Draymond Green (someone who has made several dickish comments about Michigan) had a statue that got painted, I wouldn't mind. Magic seems like a pretty good guy, though. I wouldn't have done it but a couple college kids made a choice to and I'm sure alcohol was a factor.

You're too young to remember this, but the '79 National Chapionship game between sparty and Indiana State was played in a driving rain storm with gail force wind conditions. The court was a huge mud pit by the 2nd half and the gators were thick...but that didn't stop Magic. Still not as bad as the snow storm and yetis Mateen Cleaves battled through. Happily, the NCAA stopped hosting outdoor tournament games shortly thereafter.
