Paterno family drops lawsuit

Submitted by LLG on

"Its decision today, after years of investigation and discovery, to abandon its lawsuit rather than subject those facts to courtroom examination is telling. We believe that the powerful record developed during discovery overwhelmingly confirmed what the NCAA has believed all along: the NCAA acted reasonably in adopting the conclusions of an eight-month investigation by Louis Freeh"

After what JoePa did, his family exhibits extreme cognitive dissonance in even pursuing this. I suspect the root cause is the son who really gives off a money grubber impression and uses lawsuits to try and hit the lotto.

I don't understand what any of this has to do with wins and losses and why that's a punishment.  I guess it's just the best way to get back at him?  But, clearly this stuff didn't help them win games.

PSU engaging in a concerted and coordinated coverup helped their football team in recruiting, merchandising, scheduling, etc. Those things constitute a competitive advantage. How much of one? I don't know. But I know I gave away my one PSU sweatshirt (the bounty of a football wager with a PSU fan) after the story broke. And thought of PSU and Paterno differently too. It's not a stretch to say recruits would be of a similar mindset.

DIdn't help them get wins? I beg to differ. If this all blows up in 2001 - as it should have, had JoePa gone immediately to the police and not played the "I did the bare minimum, my hands are clean" card - then PSU is emroiled in a scandal way back then. That scandal would have been nasty, expensive, and taken an enormous toll on recruiting and such, most likely.

The fiction that Penn State was somehow morally superior to other football programs was a central theme in their recruiting. Someone 3-4 years ago made public a recruiting letter that made claims along the lines that PSU was the only (or one of only a few--I can't remember which was the claim) major football program that had never been sanctioned by the NCAA, and that their tradition was winning with honor, unlike other programs.

that was obvious from Day 1.  Honestly surprised this dragged on all these years.

The Paternos may not have liked the fact that Penn State signed the consent decree with NCAA.  But it was Penn State's right to do so.  Penn State is/was a member organization of the NCAA, while Joe Paterno was not a member of the NCAA

The Paternos "beef" (a "beef" that I don't agree with, which I guess I have to add as a disclaimer) is with the University and with Louis Freeh, not the NCAA.

So does this mean the statue goes back up?

(Also, fuck every member of the Paterno family still defending Joe Paterno's actions and inactions in the face of clear evidence of ongoing child rape.  I understand that it's a terrible position for a family member to be in, but FFS, realize that JoePa was culpable in the rape of young boys over the course of decades, and show some humility.)

You have to question the wisdom of placing (I was going to use the accurate term "erecting," but...) a statue whose defacement and destruction by rivals would merit genuine goodwill throughout the nation.

I mean, we chuckle about dumping paint on the Sparty statue, but that gets cleaned up--if someone were to actually damage or topple the statue, it would be a bad look. If someone got to the Joepa statue and knocked it over, it probably makes ESPN and goes viral with almost universally positive feedback. And if the students rally to protect it...

Putting that statue up would be stupid. Not that "stupid" has been an obstacle for PSU in the past, of course.

it's been a raging wildfire for most of the last 68 months.  But the wildfire is nearly out (there's been a fair amount of movement in just the last 2 months):

*  The lawsuits are basically done.  Be it Paterno-related, NCAA-related, Spanier-related, et cetera.  (though Sandusky will try the occasional appeal).

*  All the various settlements (victims, insurance, et cetera) - done.

*  NCAA penalties are over (and would have been over this August even without a reduction).

There are a few lingering items out there: Jay Paterno may re-ignite the wildfire as a BOT member.  The HBO movie which will come out in a year or so.

But not too many lingering items.

Bringing back the statue would re-ignite the wildfire, raging as bad as ever it did.

The past is the past.  But the road to a bright future is obvious - looking forward vs. looking backwards (e.g., catering to the wishes of hanging-on Paterno Loyalists).  I'm 99% sure PSU admins realize this.

I was joking, of course, about the statue. And your take is, as usual, insightful. It's just the 99% of PSU administration comment that I wonder about. They've made some dopey moves so far - a JoePa tribute during a game ?!? - and I think they'll still suppress ipecac sales with some future decisions to appease the JoeBots. I see the PSU fanbase following a similar course as many in the old South do with Robert E. Lee and Stonewall Jackson. I.e., some continuing to mythologize Paterno for his undeniable accomplishments, while ignoring his egregious actions and inactions. Many of the PSU fans I know are clear-eyed (as you seem to be) about the situation. Many others are JoePalogists (TM) that unfairly cast a bad light on the general PSU community. That latter group speaks loudly, and aren't going away any time soon.

"Remy noted the timing of today’s decision by the Paterno family to voluntarily abandon its lawsuit was only hours before the NCAA was due to file a roughly 100-page summary judgment brief detailing the results of years of exhaustive discovery regarding plaintiffs’ claims."

Stupid Paterno fucks came to their senses at the 59th minute, no doubt at the intense urging of the family attorneys.

“The most saddening finding by the Special Investigative Counsel is the total and consistent disregard by the most senior leaders at Penn State for the safety and welfare of Sandusky’s child victims,” the report said. “The most powerful men at Penn State failed to take any steps for 14 years to protect the children who Sandusky victimized.”

And yet the family sued because of the cult of Dad and how dare they besmirch the reputation of a successful coach and master enabler. Fuck that family. Seriously.

Wow!!!  I actually like what the NCAA said here!  I am as surprised as anyone else, but I bet it doens't get much play on ESPN, or anywhere else, other than a brief 5 second placement.  And that's unfortunate...

Joe Paterno deserves to burn in hell.
“We must not lose sight of the fact that the real victims are the dozens of innocent children abused by Jerry Sandusky. ”
And this right here is why winning a fucking game against Ohio State cannot be called "the beginning of the healing process." I will hate Penn State with every fiber of my being for the rest of my days.
