Yeah I don't know that I've ever heard of a successful slander/libel lawsuit that started with a public threat of litigation.

You are incredibly correct about that. As against a public figure, a showing of known falsity or reckless disregard of the truth (or something like that) about the alleged slanderous or defamatory statement is required. Very tough standard to meet.

He probably isn't worried about winning. It doesn't really cost him anything to file the suit, and force Bacon to spend many thousands of dollars defending himself.

If he’s hiring a reputable attorney, which he should be for something like this, they will probably do some sort of blended fee arrangement so they don’t get completely hosed. Lower hourly rate with a lower contingency arrangement. Or maybe just straight hourly. Also, this guy is apparently loaded so maybe he doesn’t care.

one legal note: in the state of michigan for a libel/slander suit, in order to get punitive damages you have to make a demand for retraction to the alleged slanderer. he is setting up his bid for punitive damages which are otherwise unavailable in our state for nearly all causes of action.
EDIT: having now read the statement he put out, he didn't even deny what JUB said. not to mention, stapleton came off like an [interesting, creative expletives here].

Undisciplined is being generous based on what I have read. He seems more like one of those people who unfortunately is in a high position but has created problems everywhere he goes. Maybe he has (in his mind) good intentions, but boy does he seem to get it wrong every step of the way.

Unfortunately for Stapleton, in order to prove libel, you have to prove monetary damages from any reporting by the journalist. You also have to prove that the journalist intentionally lied about you with "malicious intent." Stapleton is lighting money on fire if he tries to sue JUB.
Having said that, I think it's much more likely that OSU and its private investigator are the source of the leaks in Signalgate vs. Stapleton.

Depends on what you mean by "source." The PI is handling the campaign; Stapleton would be the "person familiar with the NCAA investigation" who was leaking them information before the NCAA had even been informed of the matter.

If Stapleton sues JUB and discovery turns out to implicate him, this whole case goes away.
