OT: The Jason Pierre Paul saga

This is probably old news for many on the boards, as it has been circulating since the weekend.  On the 4th, it seems that Jason Pierre Paul was injured by a firework and received burns on his hands.  Yesterday, a cell phone picture of his medical record was leaked on twitter which showed that he was having a surgery to amputate his right index finger.  It’s being reported that a hospital employee took the image and sent it to a friend, who posted it on twitter.  Because of this whole episode, the Giants rescinded a $60 million offer that they had given JPP.

So, since HIPAA (please don’t comment below saying HIPPA) law was clearly violated, I’m very interested in continuing to follow this.  I work quite a bit with HIPAA law, and it’s just nauseating that a hospital employee could be that stupid and cavalier with medical data.  He may end up in jail, and he deserves to.  As for the hospital, HIPAA fines from the OCR have been in the multi-million dollar range.  That is typically due to a high volume data breach.  I’m curious to find if a civil suit could come up to that range based off of one person losing several million dollars in contract money.

Let me stop any arguments to the contrary before they are started.  Even if JPP has an agreement in place with the NFL and waives his HIPAA rights, the nature of the data breach means that HIPAA law was broken.  This wasn’t the NFL releasing the data, it was some slack jawed nurse, or IT guy, or facilities person. 

ON TOP OF ALL THAT – JPP may face criminal charges because fireworks are illegal in Florida.  The convolution runs deep in this story.

TLDR – Jason Pierre Paul blew off his finger with firework.  He may face criminal charges, but only because a hospital employee broke the law first and released his medical issue.  The Giants said “We good” and rescinded his offer.  Now there is HIPAA blowback on ESPN and the hospital for letting this come to light.  It’s only appropriate that this happened in Florida.

I agree that if you're going to eat monkey meat, the great apes are the way to go.  Go big, or go home.

I suggest poaching the orangutan in silverback gorilla milk and a winsome cabernet franc from New Zealand, then finishing it with a cranberry demi-glace.   Or raw.  Uhm, I mean tartare.

Maybe the MGoBBQ guy can do a feature on cooking great apes?  That would give the board a chance to share recipes, etc.

The law and the legal field is actually very interesting if you have an open mind. The law is ever changing and it is a living idea that changes with the times. It's actually really remarkable.

If you really think about it lawyers are fighting for your freedoms - or at least those freedoms that affect your daily life - in some ways just as the politician or the soldier do in their own way.

Also lawyers dont convince politicians, lobbyists do.

The other interesting piece to this is that JPP is not currently under contract. He was tagged and their is a date (I believe it's next week) where that needs to be finalized but the Giants can still rescind that. No idea how this ends but the Giants are a notoriously conservative organization who don't like these issues on their plate, save for LT. And yes, the worker will be fired due to violating hospital policy. If it was a career medical person (nurse, medical assistant) their career in that field is likely over (deservedly)

Fireworks aren't illegal in Florida. There is a permanent fireworks store right on the highway by me that out of staters come to. That moron shouldn't have blown his finger off and lawyers that would want to protect him suck. He can't do his job fully and should have to apply for disability.

Adam sharing that picture is a joke. I understand the reporting aspect but taking that step of tweeting an actual medical document without consent (haven't heard if JPP gave that to anyone) is a massive privacy violation, HIPPA or no.

Schefty should have the integrity to remove it and apologize. This isn't national security where public interest is best served we're talking about.

That sucks for him. Think about it, in some dumb accident you lose a finger FROM A FUCKING EXPLOSION mere inches from your face and might lose some serious money from it. I don't know how losing a finger hurts your pass rushing ability though. Should make for a brutal training camp though with jokes from fellow players. 

Don't understand people calling him an idiot though, gotta think it was a short/faulty fuse on like an M80 or something. Used to throw those things off my grandmas dock as a teenager. 

Adam Schefter did this and is getting killed by current players, James Harrison and I have the same take on this. Is ESPN above the law?

Just be happy you're still gonna have these JPP, in my opinion the only two fingers you really need

This is probably the first year I hear about soo many fireworks related injuries happening in sports. Tampa Bays Bucs backup CB also had 2 fingers amputated due to fireworks this past 4th of July

Um, JPP didn't lose millions of dollars because a medical record was released.  He lost millions of dollars because he blew his fucking hand off with fireworks.  Let's make that clear.

People's obsession with providing confidential information on celebs is astounding to me. Do people really get some kind of satisfaction from being the bozo who stumbled into this info? Its like they believe they accomplished something. This guy was so blinded by just trying to be cool to his buddy he did something he knew would get him fired.

I think that anyone leaking info to Schefter has to think twice in the future because he's clearly a moron. That said, the person leaking this deserves to go to jail for this. You can't leak personal info like that. I don't work with human samples or patient info, but even I have to take some HIPAA training. Now I'm sure I'll have to sit through more trainings because some a-hole in Florida wanted to make a quick buck.

I could see a liquidation of the hospital in order to pay the law suit for 60+ million dollars as JPP (ID10T like the guy who used his head as a mortar launcher) sues the hospital, the employee, and the friend who posted the picture.
