over and above the obvious is that it means that 'lab results' need to be submitted.  that means blood results in about 99.9% of the cases.   that means either the guy refused to do a breat test or they suspected he was also under the influence of some other controlled substance, beyond the booze. 

would be curious to read the report if one of you sleuths can get hold of it.

Also a possibility is that he claimed he was not drunk and that the PBT was inaccurate. A surprising amount of people claim that they had just used mouthwash or that they have some sort of medical condition that causes a false positive on breathalizer. Especially for morning/early afternoon DWI's.

I will never understand why people refuse a breathalyzer. It almost always results in the arresting officer getting a warrant for blood draw and the same result as a PBT. Except the Secretary of State hates when you refuse the PBT.

not unless you are absolutely dead certain that you are under the legal limit.  it is a civil infraction, $100 penalty, no points to refuse the PBT.  the PBT will be used as probable cause for your arrest and will not be used to 'help' you. 

what you are referring to as the 'breathalizyer', you probably mean the DMT, the breath test given at the station.  if you refuse that they will not only get a warrant to take your blood in a matter of minutes.  under michigan's 'implied consent' law, the Sec.of State will also suspend your license for a year.  very tough sanction.

This guy's history seems to be sports performance and training; last year he was also director of football operations; a couple months ago, the university posted a job opening for director of football operations. Wonder if it was too big a job for one guy or that debacle at Purdue was an issue?

Just want to point out that the allowable blood alcohol level is 4 times as high in the US as in Sweden, where people don't drink and drive and they have a lot less death and destruction on the roads. There they just ask the scientists what's safe and do that; here we start there and then multiply by 4 as a concession to the food and beverage lobby. If you're driving, it's not actually safe to drink at all, no matter how practiced you are at it.

roughly that of NYC. A direct comparison isn't going to work and they drive reindeer. With that out of the way I'd have no issue with a zero tolerance policy for anyone who has contact with students. This is even more ludicrous when we know the world's best Uber driver is in A2.

OMG!!! What will you ever do with a "super low" BAC? Your intuition is at odds with science. Sorry. Your freedom to swing your arms ends where my nose begins. You do realize that drunk driving leads to death, right? You can argue that marijuana laws are too strict, or other drug laws are too strict, but keeping drunk drivers off the roads really does help our country by keeping our citizens alive. Life, liberty and the pursuit of happiness and all that. Well, your pursuit of happiness (having a few beers, reducing your driving competence, and then getting behind the wheel,) ends up killing people. Again, sorry. But those are facts. Argue against science and facts all you want. You just end up looking stupid.

I'm very sorry about your loss. Most of the time I read about a drunk driving fatality the BAC is something more like 0.16 or 0.23, not 0.02. While there may be a measurable decrease in driving skill or reaction time with even that low of a BAC, there's also a significant decrease in driving skill and reaction time when there are children crying in the car, when having an interesting conversation with a passenger, when talking on the phone, hands-on or hands-free, when eating, when drinking, when listening to the radio, when singing along, and when preoccupied thinking about any number of things. All have been scientifically studied and shown to result in an increased risk. So where is the line drawn?

I remember reading a story about this guy last year, or sometime a while back...  As I recall, he is basically a data scientist using physical therapy data points to determine the best workout routines, or caloric intake, or some other such thing.  'Performance' being physical readiness to play football.  It's the algorithm's behind data science applied to athlete performance that he deals with.

Besides, he's Irish - we should probably expect him to consume some beer.  But drunk driving is dumb, mmmmkay...  Glad nobody was hurt.

Heave ho, out he goes.  Michigan has canned head coaches for simply getting drunk and obnoxious (without any driving), Gary Moeller.  DUI is simply unacceptable.

in fact, so minor they wouldn't pull you over for that during the day but at night they are 'poaching', meaning looking for any made-up excuse to pull somebody over.

the highest BAC i ever filed on was a .46.  most doctors would tell you that's a coma.  this guy was pulled over for, as you say, a bad tail light.  his driving was fine.

As someone who drives around right there daily, seriously wondering what he did to get pulled over in the middle of the day.  Must have been flying down the street, missing the previous stop sign at first and and Madison, or dodging away from cars parked on the street or something -- just usually not a very patrolled area in the middle of a regular day.

Drunk and driving before noon on a workday should check all the boxes for termination. Although he didn't have 5 dead hookers in the trunk that we know of.

Cause if you hadnt been out partying Monday morning we'd still be forced to discuss Tennesssee kickers a bit longer and nobody really wants to do that.  I mean we've got a lot to unpack here not the least of which includes:

1. How much you make relative to your willingness to call Uber

2. What you exactly do.  Nobody here really understands your role with the team.

3. Your wierd first name.

4. The fact that you got Moellered before noon on a Monday.  That's the Michigan difference right there.
