An employer may not hire you (or pay your severance) though if you don't sign the non-compete.
They aren't saying he can't be a student at UM. Of course they have no control over that.
They possibly have a right to say, he can't play football at UM. I'm not sure whether they have a right to say that.
They are saying, you can't accept a scholarship to play for free at UM. That's part of the NCAA control of scholoarships. I'm not sure of the logic of restricting transfers, but it's based on the acceptance of scholarships, not based on attending other schools period.
So what you'd be challenging is, in general, the whole series of restrictions on scholarships -- the one-year-sit-out rule for a normal transfer, etc. I am a lawyer but not an antitrust lawyer, but I think if the rules are shown to be reasonable and not anticompetitive (or at least its benefits outweight the anticompetitive effects), it's going to survive a challenge.

I just hope Gus Malzahn has sufficient Preperation H for all the apparent hurt in a certain area, if you will. I really don't understand how blocking a transfer to a specific school in another conference is anything but spite in this case - it is definitely unbecoming and a bit unprofessional. What's worse is that I don't understand why schools are allowed to meddle in transfers.

I'm curious as to why Malzahn is acting so petty. Maybe Malzahn is bitter because he was not contacted, directly or indirectly, about the recent head FB coaching vacancy in Ann Arbor? Maybe because of the satellite camps? Maybe he's famous buds with Pete Carroll or Jim Schwartz?

I can somewhat get why a coahc may not want their player to transfer in conference. "Oh yeah, sure kid! Transfer over to Ohio State! That sounds great!"
But...this is not that situation. This is singling out exactly one school out of conference. It's totally out of spite. Way to take the high road, Gus...

This happens pretty much all the time in a good number of sports. I bet you anything Michigan has done it more than once, too. Doesn't make it any less ridiculous, but at the same time, it's somewhat understandable. And incredibly common.
