1) ESPN (and other media outlets) are sending FOIA requests to MSU about the report before the USA Today article.

2) USA Today prints their article with Tracy identified as the source.

3) Tracy's lawyer releases a statement on 9/12 that says "an outside party" leaked Tracy's name to local reporters.

4) Tracy tweets on 9/12 that "someone" leaked her name.

5) USA Today prints a story that says USA Today Network reporters in Michigan heard Tracy's name in connection with rumors. Those reporters then alerted USA Today but would not reveal their sources. USA Today then called Tracy and relayed this information, and then Tracy "believing it was someone from MSU" (as written by USA Today) agreed to go on the record.

6) The State News then obtains a draft statement of the 9/12 release--how, we don't know--of Tracy's lawyer. The draft says:

“Someone associated with the MSU Board of Trustees disclosed my client's identity to an outside party. That outside party shared her identity with local media.”

Tracy's lawyer seems to verify this is a true draft and she stands by the contents of the draft but will not say who it is, implying that she actually knows who it is. (Remember, USA Today said they called Tracy to tell her about the leak and when they called Tracy, they didn't even know who the source was.)

7) According to the State News:

A copy of the draft statement was shared with MSU’s general counsel, Brian Quinn, on Sept. 12. That same day, MSU’s administration ordered an outside investigation into the leak.

But the administration didn’t publicly announce that investigation until Sept. 18. ...

As a result, the administration couldn’t immediately tell the board.

That left former MSU board chair Dianne Byrum demanding the university investigate the leak after an investigation had already been ordered.

Someone make this make sense.

Somebody leaked it to ESPN who didn’t have possession of the report. Tracy got wind of this and told USA Today to run with the story.

1) ESPN--which printed first--did not have her name in their story until USA Today printed it. They did not have her name.

2) Tracy got wind of this leak to ESPN and knew who it was that leaked it...how?

3) Your version doesn't account for USA Today's version of the story. Or did they just simply called her and told her something she already knew and she didn't have time to first go on the record, or hearing it from them pushed over the edge to agree to go on record?

Wait, I figured it out.

Someone at MSU who knew (Haller or Woodruff, or possibly General Counsel) told a BOT member about Mel and Brenda.

The BOT member tells "the outside party" who could be, like, their dog walker or postman.

The dog walker tells other people at the bar where Graham Couch (or someone) is sitting and says, "Guess what BOT Member told me about Mel and this woman named Brenda!"

Couch calls Kenny Jacoby, because he knows Big USA Today has this story.

Jacoby tells Tracy, "Guess what Graham Couch overheard the other day!"

Tracy says, "Print it!"

Tracy's lawyer actually has no idea who the outside party is or even which BOT member it is.

I think I accounted for everything there.

This dysfunctional BoT will ensure the story stays in the news much longer than it should.. and, if there’s any fire associated with this smoke - Mel’s package for separation is going to be much, much bigger.   Has this BoT done anything correct… ever?

Tucker is not going to get the full contract but if this turns out to be true regarding the BoT the settlement price likely just jumped by millions for Tucker.

Like, fuck everyone on the Board of Trustees and the Duffy Daugherty Building, but there's a whole community of people at MSU who deserve better than these clown-asses.  Kudos at least to the State News for setting the example that People In Charge Of Things can't seem to do.

Why shouldn't they leak it? How else is it supposed to surface?   Rather is should say that they revealed it. That is a whistleblower, is it not? Or should a trustee look the other way again like they did with Nassar? Hat tip to the trustee.

On a slight tangent… exactly how many tax dollars is this BoT responsible to oversee?  I believe the MSU budget is $ 3.3B.  Yes, this exemplifies why so much governmental reform is needed.

the act itself is reprehensible and qualifies as a violation of his 'moral turpitude' clause. 

who finds out about it beyond the title IX stuff is immaterial.  there could be no reasonable expectation of that news not getting out, only that it might not get out so quickly - which in this case was what, 9+ months?   

tugger gets $0.  the leak is immaterial to the clause violation, especially when he full-on cops to what happened.  sparty is a laughing stock, it's just more nationally known now.

Tucker will 100% get paid from MSU..  he won't be getting $75 million, but he's going to get paid.  There's no way they let his atty's get access to emails and texts that went back and forth between trustees, admin and the athletic department during all of this mess.

 

I'm guessing he gets $20M or so to go away and let this all end.    He is already a total POS in the public eye,  MSU is trying to do damage control on their reputation by promptly firing him (while trying to save themselves from an insane contract and get rid of a horseshit coach)...   Given the chance, he will drag this out and make public more details embarassing the university, they're going to pony up and prevent that from happening.

In fire fighting in the wilderness, I read that there is a concept that to fight a fire you set a fire. Crews would back burn towards the blaze to eliminate any fuel. Not sure if this was the idea.

With so much uncertainty and turmoil hard to imagine they'll have any serious candidates until all of this is definitively settled. ? Mid 2024?

Is there anyone else other than Tracy or her lawyer confirming the leak?

- first she said that someone leaked

- then it came out that she was in fact the source and gave the green light to the story

- she’s now saying that someone leaked her name.

Has this been confirmed by a third party? I get that she wanted to get ahead of the story, but wouldn’t it have made sense for her to let the leak actually leak something publicly and immediately green light her story?


Could the scope of a FOIA even reach beyond msu emails, docs, or texts from university phones? 

How realistic is it that the leak will come out in discovery if it’s not a board member?
