OT Chris Spielman sues OSU over likeness

Looks like he wants compensation for his likeness. Honda and Nike are "co-conspirators"
Seems pretty reasonable, especially if there's companies like Nike and Honda using their likeness (as opposed to just the university). Article also says Spielman and Archie Griffin both are going to donate any money they receive from the suit.
Donate it to OSU - then head asplode
Haha yes there's certainly more worthy causes... at least they aren't looking to pocket the money I guess ¯\_(ツ)_/¯
This Spielman guy... I think he's going places.
...couldn't read the article. Clicked on the link and pop-up ads covered the story.
So glad we can protect the rights of former athletes. While the current ones get no compensation.
Agree to a degree. If some of the pro leagues didn't have rules restricting entry into the league based on college eligibility. Seems very unjust that the players' unions in some sports are allowed to restrict entry into a professional league based on a prospect's college eligibility. Talk about collusion.
Huh?
It's not about restricting or not restricting entry...
It's about amateur versus professional.
Spielman, as a NCAA student-athlete was considered an amateur athlete. In lieu of direct compensation he received aid in kind from the University.
As a graduate, he's NO LONGER an amateur athlete and has a right to compensation. Consideration goes both ways.
How hard is it to just ask former athletes for permission?
"The filing comes after eight months of unsuccessful negotiations with the university"
Sounds like they were in negotiations to use their likeness. I'm sure it came down to money.
Being associated with OSU in advertising without your permission is a lot like what Joey from "Friends" endured during Season 1...
It's like a cow's point of view, it just doesn't matter....it's moo.
Have I been on this board too long, or did that just make sense?
Nice moment. My favorite moment in the show was still when Monica and Rachel faced-off against Joey and Chandler in a trivia contest for apartments:
Ross: "What was Monica's nickname in hgih school when she was a field hockey goalie?"
Joey: "Ooh, ooh! BIG FAT GOALIE!"
that's MISS Chanandaler Bong....
We used up all of their scotch tape last night making scary faces.
Ross: How old was Chandler when he first touched a girl's breast?
Rachel: 14!!!
Ross: No, 19.
Chandler: Thanks man.
Fun fact: this is a reference to the court decision often used as precident for these types of cases. https://www.facebook.com/benhogangolf/posts/10153417044766284
Also fun fact: I know this because my Dad inherited a set of Ben Hogan's golf clubs and only recently discovered it was because his Grandfather was the Judge in this court case.
Issue I have with players suing after the fact is this: you never know how a football player is going to turn out. Some go on to be superstars and some just don't make the cut. If Spielman sat on the bench his entire time at OSU, this lawsuit would never get filed, and he would have walked away with a free education. But since he had a successful career now he wants his image back from the school that already compensated him in the form of a scholarship? It's basically heads I win, tails you lose. What about the other thousands of players who never panned out and the University basically got nothing from them?
But he didn't ride the bench and the school and several large companies are making money off of his name and likeness, why shouldnt he be payed for it. Are you implying a university owns the rights to a person likeness for the rest of their lives because they handed them a scholarship? That's insane.
The players that never panned out are not getting their name and image posted up...not sure what your point is here.
You're looking at it backwards. The university doesn't own his likeness, and the only reason they are using it is because he had a successful career.
I don't understand your point at all. They are given scholarships to play football. Those scholarships don't come with a disclaimer that says, "By the way, we own your likeness for eternity."
If my aunt had balls, she'd be my uncle.
she just has to self-identify ;)
...and that depends on what state s/he is in!
Sorry, successful or not, you cannot use someones image and likeness for promotional purposes without their consent
What does success or not having success have to do with it?
Moreover, where do you propose drawing the line to which success (or lack theory) is achieved?
Didn't Spielman really like UM back when he was being recruited but his father was a huge OSU fan? Or something like that.
EDIT: just googled it. Yup.
Spielman exemplifies the fact that our dads are just as full of shit as anyone else. Sometimes you should ignore their advice and go with your gut.
I already had a grudging fondness for Spielman. Good announcer, really good Detroit Lion, and a good person from all I can gather.
Now he's suing Ohio State? This makes me like him ... more.
Sure why not.
NCAA Football is back!
and sued already, AWESOME!
Easily my favorite Buckeye. (#1 on a VERY short list).
Boy do I wish his dad hadn't talked him out of joining the good guys. Could have become one of my 10 favorite football players ever.
