In slow motion you can see his left elbow is down before his right arm is finished moving the ball forward - but its hard to tell exactly where the ball is when the elbow is down. Close call
To answer your question, in my opinion, it looks like Rees' attorney did a very good job to get 2 dropped, especially the battery. The battery and resisting charges were not very strong, but prosecutors are tougher on those when they involve law enforcement. Rees' attorney probably put in a lot of work to convince the DA that it would be a tough slog to get those to stick.

And as far as comparing Denard to RGIII, there is no point. RGIII always had prototypical size/arm strength. Denard doesn't. Let's be realistic.
Highly doubt that Denard will take the Pat White route. Of course Denard is completely committed to QB now because that's where he helps Michigan the most. As soon as the season is over, he'll do what's best for him as a professional.
The Pat White comparison doesn't stick - White had a lot more success throwing the ball than Denard and was a less talented runner. Plus the wildcat was en vogue when White came out. Right on about Ward / Matt Jones though.

Right or not, NFL teams draft based on potential. Harrison Smith ran a 4.5 at the combine. Kovacs isn't going to run anywhere near a 4.5.
