Berman now turning to supposed "independence" of Wells Report commissioned by Goodell. #DeflateGate

Berman grilling Nash on why some evidence used in Wells report wasn't shared with Brady team. Nash says it was privileged.

Berman: "Is there any direct evidence linking Mr. Brady to tampering?"

Stephen Brown ‏@PPVSRB 2m2 minutes agoManhattan, NY

Nash: So-called independence of Mr Wells, is...a complete red herring. Under the CBA it is not an argument that has any legal significance

Berman: Turns out Mr. Brady did better with higher inflated balls than underinflated balls. You might say he got no competitive advantage

Berman: I’m trying to figure out what is the direct evidence that implicates Mr. Brady in that deflation…in that bathroom…on Jan. 18

Nash: "Is there a text in which Mr. Brady instructs someone to put a needle in a football? No there is not such direct evidence."

Berman: I don't know what to make of that finding Tom Brady was at least generally aware of the activities of" Mcnally, Jastremski.

Judge Berman seems to be saying, I get that the legal Q is about process, but you need to convince me Brady actually did something wrong.

Michael McCann ‏@McCannSportsLaw 5m5 minutes ago

@mchorowitz @StephStradley It's possible judge wants to establish baseline on evidence before asking NFL how it used evidence in process.

Very telling Judge Berman's asking Qs about (lack of) evidence rather than application of CBA. These Qs favor Brady.

And, perhaps, most telling ...

.@AdamSchefter and Sall said "Berman told the NFL that they better come to grips that a settlement in favor of the NFLPA is very possible"

Judge Berman could be posturing in an attempt to get the parties to agree to a settlement.  Or not.  When it comes to judges, one never knows.

Having said that, I read the entire 457 page hearing transcript as well as the entire Wells report and the AEI answer to it that says the Wells report is flawed.

In my opinion, I think Brady is getting screwed.  The discussion of the Ideal Gas law, which took up a large portion of the transcript, is bad science and, imo, was destroyed by the testimony of a very credible expert witness.

Fuck the NFL.

And more ...

Judge Berman: What is the evidence of a scheme or a conspiracy?

Nash (NFL Attorney): There is clear evidence in the texts between McNally and Jastremski that (Brady) knew ...

Berman: On January 18?

Nash: No, not for that specific game.

Berman: That's the only game we're talking about. The Wells report relates only to one game. Whether it happened before, who knows. There is no finding in this case that there was anything done by Mr. Brady (in the AFC title game).

I absolutely loathe Goodell. I've always had a strong disdain for David Stern(glad he's gone) and thought he was bad, but this guy here is campaigning for the top spot.

Stephen Brown also tweeted this. On phone, can't embed.

@PPVSRB: Court reporters discussing how Berman's skepticism shouldn't be mistaken for how he would rule. Law regarding CBAs is big hurdle for Brady

Normally I wouldn't spend much time on this case.  It just doesn't interest me all that much.  However, reading these transcripts from today's hearing is eye-opening.  The NFL/Commissioner's Office are a bunch of hypocritical, incompotent imbeciles.

This exchange shouldn't be made by a first year law student.
