Matthew Loves Ball being shut down by YouTube

The best CFB extended highlights channel on YouTube, an incredible resource for us all, is being shut down by YouTube "due to copyright strikes received and accumulated recently," presumably by the greedy capitalists at Fox Sports. He is starting a new YouTube channel to continue his work, which you can find here.

Onward for the proletarian highlights revolution!

Also in things I don't understand: why do the networks all of a sudden care about this? Per MattLB's note above, he's been doing this for 5 years. He is certainly not the only purveyor of this type of content. Curious why they decided to start pulling the plug on these channel now. Wonder if it is just Fox or are other networks doing the same?

I actually chose to miss many games a year, and watch on his station. I missed the OSU game, and went right for MLB the next day after some radio silence. I would say that my case proves that Fox is making a good financial decision here, except I do not live in the USA and I have no way to legally watch these games and give Fox any money in doing so.

Man, this is bullshit. Companies don't realize that all these channels do is increase viewership for the sport, not take anything away from them. Not to mention its contested legal territory to suggest that they can't do this on YouTube in the first place. Not to mention, Fox and ESPN suck at making highlight videos, often eliding huge or interesting plays.

That's not quite accurate. For example, the NBA is going through negotiating its media rights right now, and a big concern is the younger generation does not watch games on TNT or ESPN -- they watch highlight packages on Instagram, TikTok, and YouTube. There is a real challenge to make these media deals worth it, for all involved, if people are just "consuming" content via clips from third-parties. 

Now, instead of fighting that, you may have noticed (I certainly have) the Fox, ESPN, etc are increasingly posting their own extensive highlight packages on YouTube, etc. It used to be just 2-3 minutes, now they are 10-12 minutes. They then sell ads against these packages and get money that way. But these packages are often not as good, extensive (or fun) as other packages put together, so it kind of sucks..

Now if they were *really* smart, they'd partner with some of these people like Matthew Loves Ball, let the guy do his thing, and take 90% of the revenue from ads, collaborate with Matthew on gear sales, etc. But they don't seem to be going in that direction (or at least Fox is currently not).

 

(Speaking of ads: I could not complete my comment / see what I was typing for a minute at a time because a huge "BITSIGHT: SEC COMPLIANCE" ads blocks my screen. So ads & monetizing are problems all over)

I guess "contested" is in the eyes of the beholder, but cutting up a 20-minute highlight video, providing minimal, if any, analysis or original work, and monetizing the result is a pretty clear violation of the Copyright Act.  And one of the primary tenets of US copyright law is that enforcement is the responsibility of the rightsholder -- and also that selective enforcement is not allowed.  If they do not enforce their copyright vigorously, they risk having the content deemed public domain by a future judge when they do try to enforce it.

Also, I believe this particular channel was one of those that used the FOX audio as well as the video.  The licensing terms are different -- the audio is definitely owned by FOX, whereas, IIRC, the video is owned by the home team and provided under a nonexclusive license.  That's why whenever ESPN or CBS or whomever has a highlight from another network, you'll usually hear the home radio call -- they can access both the video and radio audio through their license agreement with the home team.

(The NFL is different, as the NFL specifically claims ownership of everything in their agreements, and they have the leverage to pull it off.  That's why NFL Red Zone is a thing).

Figure Iā€™ll leave this here for those who donā€™t know. If you google search college football vods and then click on the first link (NFL-video) you can watch the Michigan-OSU game in its entirety, without commercials, in 4K. Iā€™ve already rewatched the game at-least 5-6 times.

What the fuck are these networks afraid of?

Baseball was mad about giving games away for free on the radio. It created fans and increased attendance.

NFL finally gave up the blackouts for non-sellouts.

And honestly, I'm such a sicko, I would pay a few dollars to access old games on-demand, and yet they don't even offer that. They are dumb and evil.

Why is he creating a new channel, when they're just going to shut this one down too?  He needs to find a different platform, preferably one hosted in a country that doesn't give a fuck about our insane copyright laws.

I have no love for the US copyright system but "another platform in another country that doesn't care about US copyright" is a limited list and have a variety of issues that wouldn't be remotely fun to deal with for him or his users.

What sucks in general is that these networks pay billions of dollars for these games and they aren't inclined to give up access to those investments easily.  There should be a loosening of the restrictions around these types of compilations, and maybe there will be.  As Matt noted, he has a premium subscription tier so he's making money of these highlights so maybe Fox, ESPN, etc. would let him keep the page up by paying some licensing fee.  Now, that might be too onerous for how much revenue he actually generates but it would be worth trying to figure out because everyone involved would benefit.

I can't recall which channel it was--maybe I saw this in the WD highlight thread--but someone's channel was having a similar issue even though they weren't making money off the channel.

I suppose in that situation, it's YT that's making the money off the copyrighted material, in which case it would mean YT would have to pay the networks. And while that seems fine to me, YT apparently doesn't care.

I honestly don't understand why there isn't a solution happening here. Shutting down the channels cuts off any chance at increasing revenue for YT and the networks. Is this really driving that much more traffic to their own channels where they put 90-second highlights? I find that hard to believe.

I mean, YT lets creators monetize their channels after a certain amount of time and viewership, so I wasn't saying it was just via the subscription.  They sell ads, etc. that stream before the videos.  And if I'm Fox I'm not dying to let Youtube sell ads off my content even if it has been spliced up.  And I'm sure Fox would like to charge a lot more to YT than YT wants to pay, especially since this is user-provided videos so it's not like YT has as much control and insights into what's shown.

I don't know what the solution is here and shutting down channels seems inefficient but that's likely going to have to be resolved between YT and the rights holders.

Yeah, I noticed he wasn't posting highlights recently and assumed that was the case.  Sucks because Fox and others put out skimpy highlight clips themselves.

Fox should hire him, pay him $$ to run a channel of their clips at his choosing. (I don't watch him or old clips but it seems like there's a market for them, and sounds like Fox does a bad job of giving the people what they want).

Put the big games back on ABC.  At least then weā€™ll be spared some commercial breaks and listening to Gus Johnson drool over ā€œWorld Famous.ā€

This.  He is the antithesis of somebody like Keith Jackson.  Jackson understood that every game was like a self-contained novel, telling a story with ebbs and flows.  He seemed to never stop talking but always said very little at one time.  I like Gus Johnson but I am less fond of him every year now that he keeps turning the Gus-meter up to out-do himself.

Here's why Gus Johnson calls them the "World Famous Ohio State University." IMHO it's a pretty good reason and I'm good with it.

Get off YouTube. Try to use YouTube as little as possible as it is a shell of its former glory. The content creators has made YouTube what it is not the networks.

YouTube should be removing Fox from its site if anything especially if it is intent on charging a subscription for commercial free content.
