Because under Ohio law, whether or not an OVI is a felony or misdemeanor is based on prior convictions, not the BAC. An OVI is a felony of the 4th degree if you have 3 or 4 prior OVI convictions in the previous 6 years. Ohio's OVI statute can be found at Ohio Revised Code 4511.19.
In fact, most people are able to plead their first OVI down to a Reckless Operation.

I'm a prosecutor in Ohio. Underage Consumption under Ohio Revised Code section 4301.69(E) states "No underage person shall knowingly order, pay for, share the cost of, attempt to purchase, possess, or consume any beer or intoxicating liquor in any public or private place." So the mere act of consumption is sufficient for the Ohio charge. You don't have to be in possession of it. It is a Misdemeanor of the 1st Degree punishable up to 6 months in jail.

Upshur is announcing August 8th. Mitchell maybe deciding soon, but I don't believe a date has been set. I remember seeing a tweet that Mitchell was not giving anymore interviews until he decides. That gave people the impression that he was close to a decision.

If that's the case, I'm guessing the safer bet at this point is probably Terrell Lucas, three star WDE out of Florida (Other Offers: South Florida, Syracuse, Minnesota). Michigan is the only school listed as warm on his 247 profile and has all 6 of the Crystal Ball projections. It seemed like he was all but committed to Michigan back during the Summer Swarm. I wonder if the staff told Lucas to hold off until the Kareem and Xavier Kelly situations resolved themselves. With Kareem to Bama and Kelly currently favoring elsewhere, Lucas may become a take pretty soon.

Not that Rashan, the #1 DT in the nation would be scared about competition for playing time, but here's another difference:
Looking at Bama's 247 commit lists, they took 4 DT's in 2014, 2 DT's in 2015 and already have 2 DT's in this class.
Looking at Hand's situation, again, according to 247, Bama took no SDE in 2012 or 2013, the two years before Hand's class. They took one other SDE in 2014, but that was after Hand had already committed.
The take away being, the road for playing time for Hand was much more clear than it will be for Gary. Additionally, Hand was much more of a necessity to Bama than Gary is because of the relative numbers they brought in at the respective positions in the years preceding each recruit.

I may be reading the article wrong, but it looks like Michigan granted Pipkins permission to speak to those schools after Pipkins specifically requested permission to speak to those schools. If Michigan had restricted who he could transfer to, the article would have said, "Michigan didn't give him permission to go to such and such a school." If he's already calling Michigan out about pressuring him into retire, why would he stop short by not saying they told me I couldn't go to certain schools? Saying flat out that Michigan restricted me from going to certain schools would have made him look even better and Michigan even worse.

I would agree that an ACL injury is not as "serious" for an athlete as it once was, but I wonder how many of the players on that list were diagnosed with arthritis in the knee that they injured.

A recruiting move on his part? As he said in the article, he'll probably have to play at a lower division because an FBS school won't take a guy for two years to play one year. This gets his name out there (it's not like he can go to camps to show off), lets schools know he's available, and may get him some sympathy votes from some FBS schools. Just a guess.

As a former college athlete, I can tell you I would not have taken too kindly to doctors and coaches telling me to hang them up. Sometimes the drive and desire to compete blind us from what is better for us 5, 10, 20 years down the road, especially when we feel healthy on a daily basis and have put in so much work to play a sport at such a high level. I'm not saying that Pipkins is lying or purposefully blowing things out of proportion. I just think that it is entirely possible that he does not really want to hear what the professionals want to say, which is understandable given how much work he's put in to get to this level and work his way back from not one, but three pretty serious injuries. It just makes for an ugly story for UM because the university cannot legally respond, leaving things pretty one sided.

He's a four star player at a position of need and has about as good an offer list as you can get. I realize he's being recruited at a different DE position than Kareem, but still kind of takes the sting out of losing him to Bama.
Plus, it gives us a commit in Jersey that can stay in the ear of Hawkins, Mitchell, Gary, etc.

I've lived in Dayton pretty much my whole life and haven't found anything Michigan friendly. I'm usually out with a bunch of Ohio State fans though, so I haven't been actively looking for a Michigan friendly atmosphere. Some of my favorites though:
Downtown: Oregon Express, Lucky's Taproom, Dublin Pub
Campus: Milano's, The Fieldhouse, Jimmie's Ladder 11, Flanagan's
Beavercreek: Fox & Hound at the Fairfield Mall (It's by the Air Force Base, so there are a lot of people from out of state that go there. It's not just a bunch of Ohio State people.), Kings Table
Avoid The Greene if at all possible, it is overpriced, the service sucks (anywhere you go), and not a very good environment in which to watch a football game.
Moraine / Dayton Mall Area: Have to agree with a previous poster, Chappy's is awesome and there's a brand new Frickers by the Dayton Mall that's pretty nice inside.
There are a bunch of other places I enjoy going, but not for football games. Good luck with the move and welcome to Dayton!

The wife is out of town until Sunday. I don't have to be around people at work tomorrow until 2:00 PM, which means I can sit in my secluded office all morning. Got a fridge full of leftover booze from July 4th. I'm going to start with some 7 and 7's and see where the night takes me.

Hell, he's still 17. I don't know anything about Michigan criminal law, but in Ohio he's still a juvenile. I'm a delinquency prosecutor in Ohio and I routinely have kids adjudicated of Felonious Assault (second degree Felony in Ohio) get probation. In Ohio, if you're convicted of an offense that occurred prior to you turning 18 you can't even be held in a facility for adults. You can only be held in a juvenile detention center. I wish they would send some of these kids to county jail for 60 days, but the laws regarding juveniles are a lot more sympathetic.
