Texas should win this one

It sounds like the player that would be punished the most severe was going to be injured for the first month of the season anyways.
My guess is their starters will be back in time for MSU.
August 22nd, 2016 at 1:09 PM ^
these players have to worry about the university's student review board. They issue the punishment, not the coaches. This is the reason that guys like Everett Golson, KeiVarie Russell, and Kyle McAlarney were booted for an entire year, all starters at the time.

I agree with the weed thing, half the kids are doing it and they're not getting suspended from classes or jobs or anything else. Still against team rules so make them run stairs and spend a few Sunday evenings at the local hospital volunteering.
The guns though, get rid of that shit in college fellas. No need for that
August 20th, 2016 at 10:06 AM ^
I mean is pretty obvious you're right in this particular case, but South Bend isn't a nice area. Kettering in Flint actually subsidized students to get CPLs. It's kind of a broad blanket statement to say there's no need for guns in college.
August 20th, 2016 at 10:07 AM ^
South Bend is not that bad.

Actual "South Bend" is bad, but there are pretty obvious differences between the good parts and bad parts. The area ND is in is nice, especially toward Granger/Mishawaka.
August 20th, 2016 at 1:48 PM ^
exactly. these kids aren't hanging out in the "bad areas" of Souf bend. I've lived in that area, it's not that bad.
August 20th, 2016 at 10:12 AM ^
Then get it registered. It's not difficult.
August 20th, 2016 at 10:31 AM ^
If he had this licenced, then it's nothing. You can keep a firearm in your car without a carry permit, even.
August 20th, 2016 at 11:37 AM ^
Correct me if I'm wrong, but isn't it still an issue that the gun was loaded? Whether or not the gun is registered/licensed.
August 20th, 2016 at 11:44 AM ^
There's so many state and local laws it's hard to say. Michigan for example requires both handgun registration for ownership and a CPL to keep a loaded gun in your vehicle. Other places don't have registries and have constitutional carry where there's no CPL licenses at all. Others are somewhere in between on the spectrum.

Didn't know that about Kettering, but I imagine that's a strong outlier. Certainly not against proper use of firearms. It just seems that including guns as part of the Friday night party isn't and doesn't need to be any part of the college experience. I think you're going out and looking to include that, and bringing on a lot of trouble on yourself if you do that. Have a ball guys, it's college, leave the guns behind.

The NUMBER ONE RULE for driving while high or with marijuana is ... GO THE SPEED LIMIT!!!
Any hippie will tell you this, especially a hippie armed with a gun.

They can only look into your car if something is in plane site. I've denied allowing officers search me and hence it was 1100 at night he wasn't going to wake a judge up for a warrant.

The motor vehicle exception is a legal rule in the US which allows the search of a vehicle without the search warrant normally required by the 4th Amend. to the Constitution.
The motor vehicle exception allows an officer to search a vehicle without a search warrant as long as he or she has probable cause to believe that evidence or contraband is located in the vehicle
The dog alerting on the car is all the officer needs to search the vehicle without a warrant. And because drugs can/ are hidden in the tiniest and weirdest places, the entire vehicle and contents can be searched.
August 20th, 2016 at 10:59 AM ^
The odor of marijuana is probable cause. The trooper could have searched after he smelled the order of marijuana but it looks like he went the extra mile and actually got a K-9. When probable cause exists, a warrant a is not needed to search a car due to the automobile exception rule.
August 20th, 2016 at 12:15 PM ^
Yeah, If I had a nickel for everytime I got told that I reeked of pot every time I was pulled over, or stopped on foot by a law enforcement type I could buy a decent size bag of beasters with it.
Seriously though. I've never driven while high. I don't even like to leave my house while high. Yet from 15 to 29 that seemed to be my number one offense to law enforcement "smelling like pot". Even when I stopped smoking at 24 "smelling like pot" was still their bread and butter.
August 20th, 2016 at 10:41 AM ^
If you say no and they search and don't find anything, you can have the officer prosecuted for unjust search. Likewise, if they do find something without a warrant, a good lawyer can get you off simply by saying, "What was your probable cause? What, you THOUGHT you smelled drugs?" That's why many smokers still burn incense - if it's potent, the cop has no case in saying he smelled marijuana.
August 20th, 2016 at 10:45 AM ^
You mean to tell me that "smokers" burn potent incence while driving just in case of a stop and search by police?
August 20th, 2016 at 11:06 AM ^
A cop claiming to smell weed creates probable cause. And if they don't find anything, you don't have a chance of suing successfully. That would be what is called a Bivens action, and officers have qualified immunity as long as they were following established protocols.
August 20th, 2016 at 11:08 AM ^
exactly.
just as the odor of alcohol on one's breath creates probable cause that the driver is impaired.

Oh, I forgot too many people making money off it in the current structure including jail construction, municipal fines, court fines, jail services contracting, etc, etc.
August 20th, 2016 at 10:23 AM ^
I'd agree with you. But they were driving around high, with an unlicensed gun in the car, and were arrested. So it's a bit different, IMHO.
August 20th, 2016 at 10:19 AM ^
Guns are legal. We as a society have decided that. So whats the issue? I know this is rhetorical but displays the absurdity perfectly. No Politics.
August 20th, 2016 at 10:35 AM ^
Hand guns are also legal assuming you're not a felon. BUT unlike a shotgun or rifle you have to register your handgun. Which is pretty easy if you buy the gun legally. Cannabis and a gun is a problem, especially in Indiana. Throw in an unregistered handgun and it's big trouble.
August 20th, 2016 at 11:05 AM ^
"BUT unlike a shotgun or rifle you have to register your handgun."
Not true in all states. Indiana doesn't require registration, I'm pretty sure.

Doesn't display any certainty to me. And the way they were using the firearms was illegal. My point isn't political, I'd say the same thing if they were carrying katana swords or nunchucks or minor explosives (all of which are legal in most areas) - it's not needed on a Friday night in college. If you're bringing that, you're choosing to pull that into your life and looking for that kind of trouble. Missing a great time
August 20th, 2016 at 10:43 AM ^
Firearms are for certian types of entertainment or tasks (target shooting, hunting, personal defense) - and should never be mixed with mind altering substances. If you're not actively doing one of those things, or you're using mind altering substances (including alcohol), leave your firearm at home.
August 20th, 2016 at 11:33 AM ^
So driving around under the influence of weed (at 70+ mph) is a good thing? While carrying around a handgun also?
Nothing could go wrong there...
