OT Jameis Winston did not violate code [LOCKED]
The title tells it all.
http://espn.go.com/college-football/bowls14/story/_/id/12062132/jameis-…
"The preponderance of the evidence has not shown that you are responsible for any of the charge violations of the Code," Major Harding, a former Florida State Supreme Court Chief Justice who oversaw the case, said in a letter to the parties obtained by the Associated Press and USA Today. "Namely, I find that the evidence before me is insufficient to satisfy the burden of proof."

If you or me tried to be slick and stall, lawyer up and then pled the fifth for even a *plagiarism* hearing at U-M, we'd be expelled. Promptly.

What are you talking about? There was, what, one other player there whose statement matched Jameis' and I doubt they had time to conspire (nor do I think Jameis is smart enough TO conspire). What evidence do you have against him?
December 21st, 2014 at 7:23 PM ^
Darby and Casher were with him that night and there was supposedly a video. But due to Talahassee investigation being leaked to FSU and subsequently Winston, all that went away.

A ND fan complaining about how another school handled an investigation? ND wrote the book on covering stuff up.

It could very easily mean some college kids wanted to be funny and tape there friend having sex.
If that's what's supporting your opinion, then wow.
I'm not saying you can't think one way or the other...that's on you. But just because it may have been taped doesn't mean he's guilty of the horrible crime he's been accused of...it's voyeurism and it's completely different.
December 21st, 2014 at 10:29 PM ^
he was saying because the police leaked the investigation and literally told Winston and his friends they were going to come talk to them before ever doing anything, it allowed them to delete a video that could have been incredibly decisive either way in the ruling.
This is obvious, isn't it? It was allowed destruction of evidence.
December 21st, 2014 at 10:44 PM ^
The video reportedly proved that the alleged victim was more than willing. They probably erased it because it is against the law to make the recording in Florida. If you research the story at all, you will find that the prevalent opinion there is that she was boffing him for weeks, told him to leave his GF for her and became vindictive when he refused to.
Her story has failed to stand up to the standard of evidence in Leon County, the State of Florida and now Florida State as determned by an ex-State Supreme Court judge. Meanwhile, Jaemis Winston's name will forever be linked with an alleged assault, even though there is no evidence.
I hope he makes a lot of money playing in the NFL, because it is going to be difficult for him to get a "real job" thanks to the accuser.
Does Jaemis Winston make really bad decisions? Yes. Is he a pig for screwing around on his GF? Yes. But when a county prosecutor, a state prosecutor and a former State Supreme Court judge all say there is not enough evidence against him to prove that he is guilty, I think it may be time to trust their judgment.

Maybe he's a bad guy it a good guy, but his innocence in this matter cannot be questioned at this point. Look at the actual facts yourself.
This woman is literally ANYTHING but a "poor girl". Lied about a rape

The extortion accusation was a lie. You're telling me that you actually believe that after having his reputation ruined by a rape accusation, Winston and his lawyer waited months until right before his hearing to bring up that he was being extorted?

So, do not take my word for it, take it from an ex-New York Times reporter who is probably better than either of us at going through this kind of information anyways:

Ok I just read it. All of it. And my favorite part was right at the very, very end:
"I noticed at the Clemson game, amidst all the rigamarole of Winston’s suspension, that the stadium was still selling jerseys with 5 on it. It was the only number you could buy. I remember shaking my head and telling myself I would never buy a kid’s likeness.
Well, that was just a month ago. We’ve come so far through the moral looking glass on this that I’m actually gonna drive to some place other than Play-it-Again-Sports today to buy a 5 jersey. I’m gonna wear it in Tallahassee on Saturday.
Very impartial don't you think? I mean if you can't trust a Jamis-jersey wearing, Florida State season ticket holder's version of the events of the night in question who can you trust?

Those are the smiling, happy faces of Tallahassee's finest when they announced that they would not be pursuing charges against young Jamis last year. Have you ever seen law enforcement officials as visably thrilled at the decision to not move forward against the local hero and keep him from playing in the NCG? I havent.
Every story I have read to date which is pro-Winston (like the one you link and the Reddit link below) are written by FSU season ticket holders for God's sake. Do you honestly look at that and discount their obvious bias in reporting and accept everything as gospel?

I explain this shit to my daughter so she doesn't put herself in this position in the first place. So she has some fucking self-respect, integrity, and can make good decisions. If my daughter ever referred to herself as a cleatchaser after I got done with her, her mom would be tearing her a new one.

that their statements contradict and that he can reach no finding. Period.
December 22nd, 2014 at 11:15 AM ^
...apparently went something like this (I've deleted some expletive-laden slut-shaming because frankly I don't think it deserves repeating):
Cornwell: I'd like to set up a meeting so we can try to get this resolved out of court.
Carroll: Who are you?
Cornwell: Jameis Winston's attorney.
Carroll: If you want to fly all the way down here, I'm not going to stop you.
<they meet>
Cornwell: What would it take to make this go away?
Carroll: Your client's ass in jail? That would be good.
Cornwell: That isn't happening and you know it--this is just a waste of your time and ours. What would it take to settle it?
Carroll: What, like, your client gives mine 7 mil and you never hear from us again? She doesn't want his money, she wants him in court.
Cornwell: You want to maybe think twice about that? We're coming after your client for racketeering--I just heard you demand 7 million.
Then Cornwell goes to the press claiming "extortion".
Note that aside from Cornwell's obvious shysterism of opening settlement negotiations and then claiming extortion, Carroll wasn't authorized to make a deal and there's no indication she ever discussed one with her client, who wasn't present for the meeting. And she was off the case shortly thereafter--they decided to go with someone with more experience dealing with this kind of crap.

Only traces of her boyfriend's semen were on her panties or shorts. Not from the same night, as you're attempting to imply, but from a previous rendevous days, weeks or even months prior (but most likely from Thanksgiving break, which was only a week or so prior to the rape). Why is that relevant? You're a loser for even bringing that up, in some attempt to slut shame a rape victim. Rape victims can't have boyfriends, apparently. You're a class act, bud.
December 21st, 2014 at 9:29 PM ^
Add to that ESPN seems to have an axe to grind here, being the main reporters since it broke. What does it take for a guy to be presumed innocent.

Look, if you sabotage an investigation because it's against a football player ("big young black guy hanging with other football players" = they knew it was a football player immediately) and leak the criminal report to Winston's, Darby's and Casher's lawyer, yeah you've "fixed" the case. Everything thereafter has no chance because it's relying on a farce of an investigation and the defense attorney knew the play the victim was running. The vic had no chance at any point in this fraud.

I don't think she is anything of the sort. Maybe she is an otherwise fantastic person who made a mistake. We all do it.
But in THIS situation, you shouldn't feel bad for a person who made up or even exaggerated something like this.

His innocence is most definitely can be questioned. Whether his guilt could be established may be a different matter---for they are different things. The Prosecutor acknowledged that the police botched the investigation. The NYT has covered the cover-up in detail.
Your concluding that the evidence established innocence (and repeating the discredited blackmail angle) either ignores the known facts or you simply view them with a pre-conceived bias.

There was no evidence, that's the point. The police botched the investigation so badly that there was none. They waited a month to file their report, they never attempted to get security footage from the bar. They called a rape suspect on the phone, and asked him if we would come in for questioning. Come on man.

If I was Jamis Winston's attorney I would be insanely busyI would advise him to never, EVER leave the state of Florida and to spend as much time in Tallahassee as humanly possible.
That dude is in for one hell of shock when he learns how the judicial system works when the prosecutors & judge don't have a Fathead of you on their family room wall.

Or maybe he was cleared because the police did not even attempt to investigate, tried to convince the victim nothing happened and the players destroyed evidence. All while the lawyer was shaming and intimidating the victim.
Falsely accusing the victim also happens, and it's one of the reasons why these girls are afraid to come forward.
December 21st, 2014 at 7:25 PM ^
Oh no, there was an investigation. All the evidence was shown to FSU and Winstons lawyers before being brought to the prosecutor.
December 21st, 2014 at 9:11 PM ^
"All the evidence was shown to FSU and Winstons lawyers before being brought to the prosecutor." Correct. FSU (PD) leaked the report to his lawyer days before it was sent to the local prosecutor. Same lawyer who also drafted Darby's and Casher's statements, with the benefit of refuting everything the victim disclosed in the report. Just disgusting.
December 22nd, 2014 at 10:52 AM ^
They know what they're doing in Tallahassee. You can't have a proper cover-up without doing an investigation--how would you know what to cover?
