Questions for MgoLawyers on Fridays hearing

Submitted by Malarkey on November 12th, 2023 at 8:57 AM

Sorry if this has been discussed on other threads, but been a wild 24 hours.

I was wondering what’s next on Friday, with some specific questions:

1) will the same judge that didn’t grant the TRO be hearing the arguments on Friday

2) does the TRO not being granted imply anything about the likelihood of winning/losing the injunction/TRO this week?

3) should we expect a final decision by the end of the day Friday?

Irreparable harm…..

Would the Judge agree there is no difference if she and her team reads all of the background on a case for a week and then on the court date, she steps aside for her clerk (or another person) to render the judgment?

What could happen?  The clerk wasn’t hired to be in that position to make that decision.    Could the clerk make a decision that could not be corrected later?

How much "irreparable harm" has to be done?

Seems to me to be pretty clear that replacing someone who is arguably a top 5 coach at both the college and NFL level with an inexperienced but promising offensive coordinator -- who still has to serve as offensive coordinator while he assumes head coaching responsibilties -- leaves a gap that one cannot fully compensate for.

Sure, Michigan can shuffle other coaches around - or even try to rent Nick Saban for a game or two - but no one can reasonably take the position that the team isn't worse off for having lost Harbaugh's services during the game.

I'm unclear as to which judge got this case.  But one of the judges is reportedly an adjunct law professor at UM.  Does this create a conflict of interest for them?  And, if so, does that judge need to recuse themselves?
