🔒 OT: Supreme Court rejects OSU's Attempt to Have Wrestler Abuse Claims Dismissed
Today the Supreme Court declined to hear Ohio State's's appeal from a 6th Circuit decision that claims brought against the university by former wrestlers seeking to hold OSU liable for Strauss's abuse were not barred by the statute of limitations. This clears the way for a trial and significantly increases the amount the plaintiffs are likely to get in a settlement from OSU.

Not an MGO Lawyer, but doesn't Michigan have exposure here too? I do believe an issue here was timing of the filling, but this could be a problem for a lot of universities, which is good. Curious if MGO lawyers can assist on long term ramifications for other entities that sweep these issues under the rug.

the safest assumption - with way too much of this stuff - is that there's always a possibility that it's happened here, too. we're not immune.

SOL vary from state to state. They also vary from criminal and civil. What some jurisdictions have done is expand the SOL for delayed reporting type offenses (ex: sexual abuse). I have not followed the specifics of the OSU case (other than understanding the basic allegations). Most clocks do not start running until the wrong doing is discovered. This prevents rewarding companies and institutions for "cover-up" behavior. That seems to be the courts rationale in this case.

many states have now done away with the statute of limitations for certain sexual assaults. don't know ohio's SOL, but that may be germane to the discussion.
