This is such a slap on the wrist its a joke. 

Part of a deal that resulted in him pleading no contest to two misdemeanor counts of breach of the peace. Will not be required to register as a sex offender and will not serve jail time.

The only solace we can take away from this is that people Google the names of potential hires.  I always do a cursory search when interviewing to avoid hiring someone like this.  He may not be on the registry, but people will know what he did.

I have friends who did more time getting caught smoking a joint. I don't know all the details, but not only did he share pornography of someone who didn't consent, but he also had images of underage pornography. No damn way this should have been plea bargained.

iPhones in the hands of high school / college kids is just bad news.  If you have a teen or preteen all you have to do is ask your kids if nudes have been shared with other people that they go to school with without their permission and you will be astonished.  The "sharing" may be simply passing a phone around at lunch or it may be actual images shared.  It is scary.  Like really scary. I made sure to have multiple serious conversations with my kids on the implications of such actions. Your life could be over and the harm you do to another massive.

Also, I thank God I am not a young man in high school or college with an iPhone.  I would love to think I wouldn't do anything profoundly stupid, but mix alcohol and testosterone levels through the roof and who knows. 

I pray the people hurt in this example find some healing and I hope Kitna has learned one Hell of a lesson

I remember seeing the headline back in the fall and didn't read into this. Today when I saw the plea deal, I assumed that is was more of a technicality kind of thing. Like perhaps he as an 18/19 year old had pictures of a 17 year old or something like that. Bad in its own sense, but not what it actually was by any means. This guy was sharing pictures of prepubescent girls and stuff like that. The prosecuting attorney here should be shamed for at the absolute bare minimum not having him register.

As an administrator at a fairly large high school, I just have to say that the two places where it seems the bulk of problems come from are Instagram and Discord. Usually two very different types of students but very similar problems. Speaking of Discord as that was the platform Kitna was using, just last school year I had a student with autism taken advantage of on there where he was convinced by someone on there that they were his girlfriend and needed thousands of dollars for their "child's" cancer treatment. The student got onto his parents cash app account and sent over money. Never heard from his girlfriend again. I am so glad smartphones weren't a thing when I was in high school.

Disclosure: I'm a long-term criminal defense lawyer who represents individuals charged with all kinds of awful stuff.  Also a very protective and involved father of three.

All criminal cases have nuances, especially sex crimes.  It is impossible to know what is really going on without digging deep into the context.  A few quick observations:

1. It's not child porn or kiddie porn, its child abuse imagery.  

2. There is a radically difference in the well-accepted forensic literature that has been extensively studied and validated, and which is consistent with clinical experience, between almost all imagery consumers (the most common offenders which include ), and those who are commercial "producers" (thankfully relatively uncommon) as relate to the efficacy of treatment and risk of repeat behavior (recidivism).  This literature has been cited by the United States Guidelines Commission (not exactly a bastion of liberal defense lawyers), to encourage revision of the law.  

3. Consumers include low level "distributors" who send stuff back and forth over various platforms such as IM, Instagram, KIK, etc. ("send me a pic and I'll send you one of mine").  They are very, very treatable in the community, rarely act outside the e-world, rarely have criminal records, in most cases pass polygraphs demonstrating no crimes in the real world, usually have stable employment, and if treated, have among the lowest levels of recidivism of all crimes (not just sex crimes, but all crimes).  Registration and felony level convictions actually INCREASE the likelihood of recidivism of these offenders.  Effective treatment supports public safety of these types of offenders.  Shame (although absolutely understandable) undermines effective treatment and prevents these offenders from seeking treatment.  So does the general certainty of registration.  

4. Commercial offenders and in-person creators warrant significant incarceration and have high risks of recidivism without very intense treatment.  These are the people that need to be incarcerated for long periods.  If I was a judge or prosecutor, I can tell you that I would warehouse them.

The imagery, even in the less egregious cases is so offensive and horrible, that it is often very difficult to see the differences between Nos 3 and 4, above, but it is bad policy, bad science, and very expensive to the public coffers to not check our biologically wired and entirely understandable negative emotional responses to abuse imagery.

Must have had a damn good lawyer, because it sounds like the evidence was (or should've been) pretty convincing. 

In any case, this is going to follow him for the rest of his life, and I'm guessing his football career may be over. Everyone will know who he is, and simple Google searches / background checks may end up barring him from any career of consequence. Even for the job he does get, he's going to be known around the office as "the child porn guy."

He may find that he has a hard time getting a job anywhere other than scrubbing the toilets at McDonalds.

This is sadly not entirely OT, since Jalen Kitna is LaDarius Henderson's brother-in-law, and you gotta think that while this is making us all mad in general about the systemic inequity of our justice system, it's making LaDarius sick to his stomach that his BIL is pervy scum.
