I'm not defending the University but I dont think it matters here. I too deal in HiPAA a lot at work and I know that lititgation, almost any litigation, means the medical records get introduced as part of the defense.
I think the key thing is your statement "may have obfuscated a rape". Or they may not have. And in defending themselves they are asking for the records from one other their employees - not a third party. That is not unreasonable IMO.

I think what you guys are missing is that HIPAA doesnt prevent someone from defiending themselves and in this case the Dr = the University. It appears to me that the HIPAA didnt come into play because the University said in essence "we're being sued and the person with the information on the case works for us - they are not independent."
If a Dr is sued for malpractice they are allowed to introduce patient records - the patient through their litigation creates the hole in the HiPAA protection. How is this situation any different?

I can clearly see both sides of this arguement. On one hand the University must defend itself and they are accessing the records of one of their employees in doing so. On the otther - the person seeking counseling would have no reasonable way of knowing in advance that they are are talking to a representative of the group they might someday be seeking damages from when they seek the needed counseling. To me at least there is no clear right or wrong answer here.
I think I understand now why Solomon suggested cutting the baby in half.

I thought the purpose of the sideboard was to have a discussion on issues we share a common interest in not necessarily break new ground on a topic.
There was no "cyberbullying" going on other than Don posting a link to their pictures and how exactly does that qualify as bullying? To me this thread was nothing more than a bunch of guys in a bar who watched an asshole make unproved comment after comment to some guy about his wife get punched in the mouth and we're all, for the most part, agreeing he got exactly what he deserved..

Time value of money. If he's a mid first round pick he'll be looking at several million dollars that he'll have year one that he would never be able to recapture.
What's limiting is a pro athlete's career length. The BEST he's going to do is play into his late 30's and most are out of he league far before then. What will always be there is his opportunity, should he desire it, to go back to school and finish his degree.
What I wonder is why anyone stays if they know they are going first round, not why they leave.

The truth is neither of these two losers would have the balls to say anything remotely this vile anywhere near Schilling in real life. It's only through the "protection" of their internet annonimity that they muster up the courage to be this big of an asshole to another human being.
I think it's absolutely wonderful. Wish it happened more often and I hope this inspires more people to take action and not adopt the "dont feed the trolls" mentatlity. If more shit like this took place there would be far less trolls.

2. Wife's dad was a charter season ticket holder (had the seats since 1950) and has his name on the front entrance of the stadium on a plaque with the other charter season ticket holders. When we got married in 2009 he gave us the PSL for the seats (dead on the 50 yard line - row 1 of the third deck) so I'm sort of obligated to keep them. He passed away last year so when we go we do so in memory of her dad.

Yes they should've but unfortunately the GM Farmer is unwilling to admidt Johnny Football is a bust and Hoyer was unwilling to "play nice" and tutor his currently useless ass. He wanted a legitimate chance to start and the Browns basically want a QB who will keep the seat warm until such time that JF learns the playbook apparently and can be put back in.
If I was the GM for the Browns I would've resigned Hoyer and then taken the best player (regardless of position) at the 12 & 19 slot. I would've beefed up the WR's & OL via free agency and given Pettine a contract exension and begged him to not quit this three ring circus.

The point you are apparently unable to grasp is that NOBODY here is saying S&C coaches are irrelevant or interchangeable. What we are saying is that the on-field results have a slight degree of variance between the very best S&C coach and the very worst. And that no matter who we have in charge - there is universal acclaim that the current guy is WAY better than whoever he replaced and the results are just amazing.

The point wasn't that they don't matter-they obviously do. The point was their impact is greatly overblown relative to the team's performance and I happen to agree with that statement.

If it's our current S&C potato then it will obviously be the most amazing, physically transforming potato EVER. They players will remark how this potato "gets it" and his workouts have produced absolutely stunning results that will surely translate into fourth quarter dominance and win and win this fall. You will see before and after pictures demonstrating visually the positive impact this potato brings to the S&C table.
If it was the previous S&C potato then no. That idiot knew nothing (obviously) and is now probably just french fries.

No what he's saying is the following:
1. All S&C coaches have some measure of competence or they wouldn't have been hired in the first place.
2. That people on the internet fawn over whoever the current coach is claiming that NOW we've got the guy who will make all the difference and demonstrate real, tangible results.
3. That the impact of the indivudal coach is vastly overrated. That the players themselves and their willingness to put in work makes the difference (for the most part) in performance.
4. That the overall mpact of S&C coaches in general is greatly overrated
5. That if we did hire Garfield the Cat we'd be reading reports about how impactful GTC's workout's are and the amazing, increadible changes he's making in the team's conditioning and that a bunch of people here would agree.

I believe you are correct. It was a LONG and difficult road and we just had the rededication of the house last year. OccaM does an excellent job above outlining the various steps that have to be taken to make it happen and his list isnt by any means comprehensive.
