Yes, Ward was reckless. Yes, he wanted to get very close. Stewart also wanted to get very close, which is why he fishtailed. I have a hard time believing Stewart intended to kill Ward, but there is no doubt that he wanted to at least scare him and at most clip him. I also have never seen a stock car race and know nothing about these individuals. So I have no bias.

One thing I noticed looking on the video again is where the other cars were driving on the caution as opposed to where Stewart was. He was much higher up the bank when all drivers know you stay low to give the driver clearance. Stewart was the only one who actually came pretty close to Ward's car. I think he was playing a game that got out of hand.

All the discussion on this thread shows that there is enough reasonable doubt to preclude a jury from convicting Tony Stewart of a crime. Kevin Ward contributed to the incident through his own negligence and no one knows Stewart's intent but him.  Considering the circumstances, there probably isn't even enough to indict Stewart of a crime, much less take him to trial.

I am actually from Canandaigua, NY.  It's a beautiful town with the second most expensive lakefront property in the US behind Lake Tahoe.  Being such a small town you can imagine all the people talking about it and all the news crews descending on the town.  It's a tragedy all around and I send my condolences to the young man and his family.  This isn't Tony's first time hitting someone so I think it should be looked into deeper, however I don't think any charges will or should be levied against him, although I'm almost positive he will get sued for wrongful death.  Any lawyers or those in law school:  Do you think a wrongful death case is coming??

any more than he would be charged with murder if a spectator came down out of the starnds and ran onto the track and got hit and died.  Anyone stupid enough to try and aggressively confront a moving race car takes their life into their own hands, period, including Stewart when he has done it.  Maybe atter all of this BS people will think twice about doing it.

 

I have no idea if cops iwill find some lesser charge to bring him up on like negligent homicide or something, but there is no way this would ever be murder.
