Obviously I'm not a lawyer, but it seems to me that if someone assaults you while on the job that charges could be filed. Garrett used Rudolph's helmet as a weapon and I don't know what specifically about the NFL precludes assault charges being filed, unless it's some collective bargaining thing.
November 15th, 2019 at 12:17 AM ^
No collective bargaining agreement--no civil contract of any kind--can override criminal law. The state's not a party to the contract.

That would be my understanding also. It will be interesting to see how the league and NFLPA deal with this. Garrett appeared to be using Rudolph's helmet as a weapon, with intent to injure

Prosecutors tend to have a high bar for taking on cases like this. For one, athletes are considered to have consented to the risks ordinary to their sport, so the action needs to be far outside typical conduct. This was. But as a practical matter the victim would need to have suffered a serious injury too. If Garrett had hit him flush, fractured his skull or something, there'd be a real possibility of charges. But no prosecutor's charging this.

A prosecutor might not charge, but the civil action for assault and battery still seems like it would be on the table.

If Rudolph wants to humiliate himself, sure. What damages is he going to claim?
November 15th, 2019 at 12:07 AM ^
Tell that to Marty McSorley and Todd Bertuzzi... you’re comment is dumb and everyone on this blog is now dumber for having read to it. I award you no points, you should be negged into oblivion, and may god have mercy on your soul.
November 15th, 2019 at 12:11 AM ^
If you are aware of a legal precedent that precludes that possibility, I'd be interested to hear it. Otherwise, spare me the Billy Madison bullshit.
EDIT: I was looking at the thread on my phone and the site doesn't always format correctly. My apologies, mea culpa.

The NHL for sure had some assault charges filed. I’m not sure about the NFL but I doubt it.
This went so far beyond the realm of sporting that I could see it being considered.

I mean, you realize he was agreeing with you, right? Check your indentation level next time.

"you're comment is dumb" ?

Ya man, apostrophes & shit. I don't agree that everyone is dumber for reading it though. Some of us prefer to learn from other people's mistakes rather than our own.
November 15th, 2019 at 10:30 AM ^
Cringeworthy. Although not nearly as stupid as the brainless moron's that use apostrophe's for plural word's. My god. That it is one of the easiest rules to remember from grade school English classes. If it's possession you need the apostrophe. If it's plural leave the gotdamm apostrophe out.
November 15th, 2019 at 12:30 PM ^
I assume you're joking, so *classes'.
November 15th, 2019 at 12:50 AM ^
Bertuzzi, McSorley and Ciccarelli would disagree. Might not have happened in the NFL, yet.
November 15th, 2019 at 7:38 AM ^
Marty McSorely was found guilty of assault of a weapon for hitting Donald Brashear in the head his his stick...seems pretty similar.

One possibly material difference between the cases is that Brashear suffered a grade three concussion and was having seizures on the ice. Randolph's injuries seem to be limited to possible emotional distress.
Every criminal case I can think of has involved some fairly serious injury--the three hockey cases we've already dealt with, the soccer case in England a while back left the victim eating through a straw. Anybody know a precedent that didn't?

If you provoke a man you may face the repercussions - the same way Garrett is about to for doing something frowned upon. You can only control what you do, you can’t control how anyone reacts. Most men operate on the basis of “don’t fuck with me, and I won’t fuck with you”.

If the helmet don't fit...

. . . tear it off your opponent and strike him with it!

MODS: There's a second thread, started at about the same time as this. It seems to have more discussion, so feel free to delete this one if it will reduce board clutter.

I like how Rudolphs team mates reaponded.
November 15th, 2019 at 10:57 AM ^
Friendly reminder: These teams play again December 1.
November 15th, 2019 at 10:11 AM ^
I've seen a few videos of Rudolph yanking Garrett's helmet rather violently which started this whole thing. It seems Rudolph started it but Garrett finished it, viciously. IMO Rudolph should get fined, Garrett should get fined and suspended.
November 15th, 2019 at 11:15 AM ^
Rudolph also kicked him in the balls and punched him in the balls. Garrett deserves to be done for the year but Rudolph should get 3-4 games.
