a very good friend of mine dated a Purdue football player who was recruited heavily by Michigan. There's so much shitty stuff that gets pushed under the rug at Purdue even though the team is trash. I hope justice gets delivered. This is horrible.

Wait so no arrests have been made and there has been no Title IX hearing with the school yet, but the law firm is pushing to expel the students? Nice way to blow your credibility as a firm.

If the Duke Lacrosse case showed us anything, is that INNOCENT until proven guilty NEEDS to be our stance.

This does not discount the victims claims, but without any sort of legal proceedings or even Title IX hearings going on - we need to keep this in mind.

The firm is demanding punishment without any sort of process.  That argument is asinine even by small plaintiffs' firm standards - don't think I need to hear from the players on that one.

The firm can say any dumb thing they want, of course, and zealous advocacy is great, but people are allowed to think statements like those are dumb.

What is the plaintiffs' lawyer supposed to say here?  "Well, we have our clients who seem kinda sorta believable to us, so we filed the suit.  But we still think that they defendants should be out in society, perhaps committing crimes, perhaps not.  Who's to say, and who are we to judge?"

The plaintiffs' lawyer has an obligation to zealously advocate for the firm's clients.  And the firm's clients are accusing the players of sexual assault.  It's the school and law enforcement's obligation to ensure that due process concerns are balanced with student safety concerns. 

(And it's the school and law enforcement - including a dopey prosecutor - that made such a hash of the Duke lacrosse case.)

In our adversarial system, law firms are not the arbiters of justice. Firms have a duty to serve their clients' interests. This firm is doing that. 

The school and court system will determine their guilt.

This law firm did not, in any way whatsoever, damage its credibility.

That's true. I made my comment in haste. I just think that it opens up the firm to scrutiny and a possible defamation lawsuit by making such a bold statement if there ends up not being enough evidence.

Or would this be covered by Litigation Privilege? I'm by no means a lawyer, just trying to learn.

Their statement asking for other potential victims to contact them sounds like they're trolling for business. Correct instruction might be to go to the police. Perhaps I'll stay up and see if the have a 3am commercial running.

“If there are others out there who have been victimized in this manner, we encourage them to contact us to get the justice they deserve."

 

I do hope that if there is other victims they get the help and justice they deserve, but this reads more like a daytime infomercial for a law firm.  I wonder if it could have been worded better to avoid that.

Expelled before any proceedings? Ridiculous. Not taking an additional snap in a game or on the practice field until this is cleared up? Totally justified.
