OT: Brian Kelly being sued by former ND player for concealing MRI scan & permanent injury

A former Notre Dame player is suing the university for allegedly concealing results from an MRI and instructing him to keep playing while he was risking a spinal cord injury.

A lawsuit filed by former Irish linebacker Douglas Randolph, obtained by The Indianapolis Star, states that Notre Dame did not provide results of an MRI that Randolph underwent after experiencing "numbness in his upper extremities" stemming from a hit in a practice drill in September 2015. Randolph played the entire 2015 season and later was diagnosed with spinal stenosis. He also might have permanent nerve damage in his neck, according to the lawsuit.

No surprise to me, he was horrendous with violations and breaking rules when coaching at gvsu. I have a friend that played for him and he should of been fired from there way back when for violations etc.

People overlook a lot when you win.  Overlooking crap like this with such a mediocre record makes me wonder if he made a deal with the devil.  Interesting how UM completely bypassed him during a prior coaching search.  I guess it's one thing DB got right.

Yes. I completely agree. I was outside in Chicago on the day Declan Sullivan died. The wind was so strong it picked me up off the ground. At 210 lbs. There is no way that kid should have been in that scissor lift. Absolutely none. It was criminal negligence and borderline manslaughter. And nothing came of it, except for a $40k OSHA fine or some shit like that, and ND offering scholarships to Sullivan's siblings. It was and is disgraceful. Justice has never been done for that death. 

I say this fully and wholeheartedly: If the exact same thing happened at Michigan, I'd want the coach-- including, yes, Harbaugh-- fired immediately. This was black and white. The kid didn't want to go up in the tower, but Kelly made him, via an intermediary who Kelly ordered directly. And it was batshit insane-- the sustained winds were in excess of 30 mph, with gusts over 50 mph during the relevant time period. Like I said, a microburst picked me up off the ground that afternoon. And I ain't small. 

I've never gotten over this, and will always be angry that there weren't really any repercussions for what I view as a criminally negligent act whereby Kelly is directly responsible for the death of an innocent student.

Yeah you're absolutely right.  That doesn't mean Michigan fans can't point it out though.  Most of us were shocked when Hoke left him in.  I was freaking out and yelling at the TV to get him off the field.  The university community was outraged and that ultimately, was the nail in the coffin for Hoke's firing.

The injury occured in Septemeber and he played the entire season without knowing results of the MRI? Something seems really off. Doctors are putting their asses on the line for Kelly? Kelly and staff completely stonewalled telling the kid the results for that long time? The player or his parents didn't inquire about the results? Were the results lied about or told they were not back yet?

If the kid is correct, then Kelly, the trainer and the doctors should be done for.

I'm having a hard time seeing how he would have been with the details of this case. He's named in the lawsuit because he was in a position of authority, but the issue is with the medical care the player received.

At this point we don't know much. The player says he would have quit if he had seen the results of the first MRI, but he still hasn't seen it. They showed him the results of the second, which revealed a serious problem. Why would they hide the first and not the second?

There's a lot to be learned in discovery. Was his injury misdiagnosed? Was it not detectable until it worsened? What kind of instructions did Kelly give the trainer? Those might have led him to some questionable decisions, but I find a conspiracy between Kelly, the trainer and the team doctor to cover up potentially serious injuries hard to believe.

I did not click to read the story, but since I have congenital spinal stenosis and bulging discs I have had several MRI'S. They send the results directly to you and usually hand you a disc before you walk out of the hospital. I really do not see how they can keep the results from him. He can show the disc to any neurosurgeon of his choosing and I would hope he knows how to read. I would have to say this is flat out bullshit.

Hide the results that are documented on a computer and disc. Boy someone would really be taking a grave risk of not only losing a job they worked extremely hard to get, it would take some kind of conspiracy. It would have to involve several people. These people are subject to prison and never working in the medical field ever again. How much was Notre Dane paying for a middling player.....laughing.

So he's saying that he just believed what they told him and never asked for a copy of the MRI. Ya with all the pain I was in, I would have been good with the hospital saying we don't have a copy of your MRI but hey your good to go. Get the fuck out of here!!!!. If they refused to give me a copy to me or my doctor I would have started counting dollars in the millions that hospital would be liable for. The kid also could just go have another MRI done at any place of his choosing, but ya Notre Dame and Kelly have all the hospitals in Indiana, Illinois, Ohio and Michigan on lock down.......laughing even more with your bullshit conspiracy theory.

If this kid and his parents never followed up on not recieving a copy of the MRI after experiencing numbness. Well I just don't know what to say. I imagine the kid or his parents have their own doctor and that doctor would have to be in on it also as they would have demanded a copy if one did not arrive in a timely fashion. Anothe rdoctor losing there job for a middling Notre Dame player as the conspiracy grows.......laughing even more at you believing this horseshit.

Also with the hippa laws Notre Dame can't even look at any medical stuff without his permission. Fuck it believe what you want, but if that kid or his parents wanted a copy of his MRI ther is no way in hell they would have kept it from them and even if they did, wouldn't that have raised some red flags or you would just trust the word of Brian Kelly who should not have access to his MRI in the first place. Go find the guy on the grassy knoll.

This isn't your normal doctors office. Coaches are like parents to these kids. I'd argue that MOST players share their injury information with their coaches as it's likely in their best interest. And, it only takes one shady coach, one shady doc, and one overly trusting kid to maket his happen. If you think there aren't people out there willing to risk their careers for football that brings in millions then you haven't been paying attention to what happened at PSU or Baylor.

 

I'm not saying it happened, but it's not the stretch you are trying to make it out to be.

Why are you arguing this point with me? I understand how this all works. I'm in medical device sales, I'm in hospitals all week. Nothing you've written actually happened. That's why this is a big fucking deal. Sounds like you need to focus your energy on making a difference in this situation. Maybe contact this player's family or lawyers and provide them with your insight.

There is so much wrong with your comment. 1. The kid signs away Hippa when he signs his schollie paperwork. They have them sign a form for that. 2. The concept that TEAM and UNIVERSITY DOCTORS wouldn't work for the UNIVERSITY and not the patient...despite whatever hippocratic oaths are taken...is, umm, one that NFL doctors have proven to be the case time and again. 3. The number of assumptions you're making-- such as that the kid has his own doctor and that the doctor would demand the discs-- is astounding. 4. You also clearly don't have a lot of experience with litigation, do you? You think a Hipaa violation or a delay in providing imaging would have you "counting your millions"? Dude, you are wrong. Seriously, utterly wrong. Source: I'm a practicing litigator. God, I would love to defend a case like this against a plaintiff with your worldview. Settle for a few thousand? Sure. But "millions"? Lololol.

Are you serious? I've had 2 MRI in the last year. Never once did they "hand the discs" to me. I had to order them, through the records department of the hospital, and then pay for them. And then they were sent to me, weeks later. 

Just because your medical provider does something a certain way doesn't mean the kid's story is "bullshit."

What did he do/say that made him a racist? I hadn't heard anything like that about him of course, but I guess I have to remember that "YOU'RE RACIST" is all too common a label regardless of truth. It's definitely the "in" thing to call someone if you want to try to discredit him/her.

I guess some of it's in the eye of the beholder.  See my reply below for the factual basis - it's not just lazy name-calling.  Lots of people found Kelly's comments to be racist.  And it was widely reported at the time (and a reason that there was not a big push to hire Kelly at Michigan at the time).

Of course some don't see racism when people are walking in a protest marching chanting anti-semitic and nazi slogans while carrying torches and wearing a pre-agreed uniform.  There's certainly something to people seeing what they want to see. 

Also, most zebras I've met are some racist mofos.  Xenophobic as can be, too.  It comes out when they drink.

The gist of it is that about 10 years ago when he was coaching at CMU a number of players beat someone to death.  IIRC, most of the players were not his recruits, but in any event he was quoted as saying about the players that  “a number of them were African Americans that had been in that culture of violence.”

That's pretty racist.  I'd be inclined to write it off as a mind fart but for two things.  First off, Kelly is inarguably an asshole - ask anyone who has played for him or worked near him.  If you're chronically an asshole, then you don't get an automatic benefit of a doubt in my mind.  Second, his comments touched off a firestorm in Mt. Pleasant and elsewhere.

This is a bit through the fog of memory, but it's the gist of the matter.

I don't toss around "racist" lightly and took your question seriously (ignoring the gratuitous shots you took with your second and third sentences), so I dug a bit into it.  It's worse than I remembered.

 

In June 2004, three months before Kelly had coached his first game at CMU, a fight involving at least four of Kelly's players outside a Mount Pleasant, Mich., bar resulted in the death of a 26-year-old man named Demarcus Graham. Police investigated 11 CMU players who were among those at the scene. Two former CMU players eventually pleaded no contest to involuntary manslaughter and two pleaded no contest to attempted assault with a dangerous weapon, according to court records.

Kelly responded with team discipline as well as any new coach could. But he embroiled himself in controversy explaining why several CMU players may have perjured themselves trying to protect a teammate.

"For example, a number of them were African-Americans that had been in that culture of violence, and they're taught to look away," Kelly said in the Sept. 22, 2005, edition of the Detroit Free Press. "You don't want anything to do with it. Get out of there. You don't say anything to anybody.

"That is a culture that they are immersed in. When they come here, their first reaction is to react the way they've been taught to react in their culture and in their environment. That's difficult."
