Logan Tulley-Tillman pleads guilty

Logan Tuley-Tillman, 20, pleaded guilty to capturing or distributing an image of an unclothed person and using a computer to commit a crime during a pretrial hearing on Feb. 8 in Washtenaw County Trial Court. Under an agreement with the Washtenaw County Prosecutor's Office, an additional count of capturing or distributing an image of an unclothed person will be dismissed at sentencing.

Worth noting is that he's being sentenced under the Holmes Youthful Trainee Act, which is fortunate for LTT because otherwise

 

Without the Act affecting the sentence, Swartz said capturing the image is a felony punishable by up to 5 years in prions and a $5,000 fine and using a computer to commit a crime is a felony punishable by up to 7 years in prison and a $5,000 fine.

In-person solicitation is not allowed, mailing is fine.

Representation of the "protestors" will be challenging as I predict the court will, after pretrial motions, disallow most, if not all, of their expected defenses. I also predict the protesters are unlikely to be satisfied with the court's rulings and their lawyers' explanations. Expect long, dragged out proceedings, defendants terminating several sets of lawyers, and some defendants proceeding pro se (as their own) counsel and convictions. I've represented defendants similarly situated and it can be quite tedious and frustrating, and it will be difficult for their lawyers to win their clients' trust and confidence.

I won't be soliciting representation by mail (I find that distasteful) but would consider if approached and if their was "room" in my caseload.

As bad of a situation as this is, it could've escalated into much worse.  Luckily, both parties seemed to have handled it maturely.

LTT for admitting his guilt.  

Also, the victim for admitting she wasn't completely innocent in what happened, but at the same time being strong enough to not let her personal rights be violated.

I think both will learn and move on with no issues.

I see the up-to-7 years in prison, and a $5000 fine, and think to myself: what the hell is the point of the fine? 7 years in prison! That'd be like cutting your hand off for stealing, plus they're going to insult you. Lawyers fees are likely around $5000.

Totally agree seven years is way too much time for hiim and for the state to being paying for.  To accomplish what?  It looks like he has already paid a great price and even if the charges are eventually removed the fact that he is a public figure means the case really never goes away.

Seldom do defendants receive the maximum. In my 25+ years of criminal defense practice I can think of only a two cases where that has occurred on even a single count.

Not sure about Michigan, but in many states there is "indeterminate" sentencing so that, for example 7 yrs is the maximum period of incarceration plus parole. When Oregon had indeterminate sentencing, a five year sentence often meant 6 mos followed by 4.5 years parole, during which if you messed up again, you could be returned to prison, then paroled, repeat, for up to five years.

And $5K in legal fees would be well-below market to defend these types of charges for a skilled and experienced private lawyer.

Interesting that the article says "he has not officially committed to another program." There were reports a couple weeks ago that he had committed to Washington State. Just saw that he'll soon be officially visiting Houston:

Man, the only post all day and not even football related, much. I'm having withdrawl, how long until something football related happens?

Guess I'll go watch WD's version of the Gator beatdown again and imagine what next years players would do in this game. How did we let Harris escape the pocket on the first play, man that angers me! I need a life.

IANAL, but those laws seem overly broad. 

If you downloaded a pirated MP3, wouldn't that be using a computer to commit a crime?  Would it really be heinous enough to be considered a felony?

Or, say, a naked drunk walks up to a Fleetwood waitress and asks for a side of ranch (actually happened) and tou take a picture and email it to uyour buddies.  Would that make you a felon? 

It seems really easy to run afoul of those laws.

Getting HYTA is huge. Nothing will go on his permanent record and this won't hinder his future at all. As long as he gets everything together he can be very successful going forward. Good luck to him !
