So says a OSU poster on the Ozone board. Can't wait to hear Gene Smith tell us this is just another "isolated incident."

I wish we could just ship those cheating cooler poopers off to the $EC where they belong.

And I'm saying if you are soberly refusing to roll down your window as a protest of infringement on your civil liberties, you are going to need an attorney.
Despite however you may feel about them - the Supreme Court has upheld their legality, and this Supreme Court has demonstrated the only rights the majority care about is the rights of big money political donors.
I would not advise refusing to roll down the window and answer the officer's questions if you're sober. If, on the other hand you are intoxicated, and so impaired you don't think there's any chance you slide by, why not exercise your "rights" and introduce some libertarian arguments into your dui trial?

I'm aware of the case, but this is far from settled. They can set up checkpoints, but one does not have to do anything more than say he does not agree to searches and refuses to have a "so where you going tonight" conversation. If one does this there is a very good chance they just let you go. But if they detain you without any reason other than you didn't want to let them give you the third degree and show them your license for no good reason, then there is about a 99% chance it gets thrown out of court.

The best way to stop drunk driving is 1) focusing on drunk drivers, 2) having very significant and certain consequences for violations, and 3) promoting alternative modes of transportation for people who've had too much. I'm pretty far from a libertarian, but on this issue law enforcement has gone too far.

Because we all know that people get smarter after consuming alcohol.

Sorry but making responsible decisions, such as calling a cab, isn't a common side effect of getting drunk. In fact it's the inverse. Everybody feels "totally fine" to drive until they get pulled over, regardless of their blood alcohol limit.

Excluding Kevin Grady of course. He was drunk as fuck.

MADD, which is now a neo-prohibitionist organization, has done an excellent job selling their propaganda. There's a vast difference between having a quart of vodka and driving, or a couple of beers. And yet in many states the crime is treated the same. Personally I think dui laws should have a graduated punishment system.

They were. In Michigan. Under the Michigan constitution. In the same case, Michigan v Sitz, in 1984, the US Supreme Court upheld them as permissible under the 4th amendment. So that case resulted in two polar opposite outcomes depending on whether you live in MI or the other 49 states.

That apparently turns out to be a quote from a text exchange between Gene Smith and cleveland.com.

 

"Every case is different," Smith wrote.

 

No doubt--there's an analysis of the importance of the player to his team player's character and past history and appropriate penalties are assessed after examination of the team's schedule.

There's supposed to be a link to OSU's student-athlete handbook, but it's broken. But as far as I can tell, the only mandatory penalty for a DUI is that you're subject to future testing for drugs/alcohol. Here's a link to an older version of the handbook.

the rollover would not have done much for our program. it was Ed Martin being investigated by the FBI that uncovered all the bad stuff. OSU can keep sweeping this under the rug because the NCAA lacks subpoena power. unless this dealership has crossed the feds in some manner, nothing will come of this.
