OT Elin reworking pre-nup

Looks like she has ole Tiger by the balls. Am I the only that is kind of disturbed that this reads like business deal? Elin and Tiger Woods had a prenuptual agreement, as expected. The couple is undergoing marital counseling, as you'd also expect. And now The Daily Beast is reporting that Elin Woods is renegotiating that prenup to get an immediate $5 million payout from her husband and as much as $55 million more to stay with him for two more years. http://sports.yahoo.com/golf/blog/devil_ball_golf/post/Details-of-Elin-…

I thought the whole point of a pre-nup was to prevent a money grab like this. Tiger would have to agree to the renegotiation and sign it...maybe I'm missing something here. Edit: This makes me wonder if the whole marriage/relationship was a sham to begin with. That's awful to say, especially with kids involved, but it made Tiger look like the perfect all-American hero = more money from sponsors.

Well I'm sure they're all different, but I think prenups generally have an exception if the side with the assets commits adultery. I assume their prenup either spells out a specific amount she would get in the case of a divorce due to infidelity, or simply does not apply if the judge finds infidelity to be the primary cause of the split. This is why I think many couples are so willing to do these - it not only protects people like Tiger from golddiggers, but also protects their spouses by creating a huge financial penalty for cheating.

Given the substantial number of marriages that end with infidelity, it seems to me that would be an important part of any prenup. That's why the idea of renegotiating it seems odd to me: either it was already in there, in which case she just wants more, or it wasn't already in there, in which case...why?

If she divorces him, she will get $300million. Maybe I am missing something, but if she stays with him, doesn't she get to have/spend his money anyways?

At this point, what's the difference between Elin Nordegren and an escort? Pretty inconsistent that Elin Nordegren can say, "I'll remain married to you if you pay me $5 million," but prostitution is illegal.

Hmmm, she got herself a nice roster bonus, and a pretty good signing bonus, on only a 2 year deal to play on the Wood's Nuclear Family for Formals and Public Relations. Very shrewd deal. Should have thrown a mutual option for a third year though, don't want to end up as a free agent again, she might find trouble signing another lucrative contract as a trophy wife.

Can someone explain his and her incentives in this? I'm confused ... why should she get money for staying with him? What if she doesn't stay with him? Does she have any tangible leverage, or is she just banking on the fact that Tiger wants to stay married?

The general sense is that Tiger needs a trophy wife for various reasons. Public appearances, going to charity dinners (Or what ever else like that), and just general perception. That's not concrete, but it's what most people I've heard assume (makes sense). What if she doesn't want to? It appears that she does want to be a trophy wife for a contract like that. Although, some people I've heard have said Tiger was on board with the contract, but some things imply that this is her doing on the most part for now.

I think the incentives will continue to pile up as time progresses. Maybe she can still divorce later, because your right, it wouldn't be a good deal to take this over divorce. Maybe she wants the lifestyle still, I'm sure she does many things she wouldn't get to do without Tiger. All hearsay of course.

The article also mentions a non-disclosure agreement preventing her from giving her take on what happened, which makes the payments make a lot more sense. As commenters on the linked article point out though, all of this information is highly suspect because of the privacy TW so aggressively maintains.

So she is going to stay with him for 2 years and THEN divorce him? I don't get it. Either she forgives him and they stay married or she doesn't and they get divorced. Period.

Apparently, Tiger's not the only one who thinks you can. It reminds me of the movie in which Robert Redford offers Woody Harrelson a million dollars to sleep with his wife (Demi Moore). As people walked out of the movie, they asked a woman if she would sleep with Robert Redford for a million dollars. She said: "Yes. But it'll take me a while to raise the money."
