Running Back.    Anthony Thomas for size, speed and production. Man won a NC as a true freshman, for heaven's sake.  Tim Biakabutuka if only for the OSU game in 1995. A man among boys that day.

Center.  Gerald R. Ford.  Because otherwise all that stuff they say about the game building men and character means nothing.  Plus, he was a pretty good center.

The University of Michigan and the Civil War

An alumnus of the University of Michigan brought to a close to one of the final chapters of the Civil War. 

After the fall of Richmond, Jefferson Davis fled, hoping to get to Texas to continue the war from there.  He fled south for several weeks, before finally being captured near Macon, Georgia by the Fourth Michigan cavalry. The Fourth was commanded by Lt. Col. Benjamin.D. Pritchard, an alumnus of the University.

Belisarius, had Chamberlain failed in defending Little Round Top on Day 2, there almost certainly would not have been Pickett's Charge on Day 3.  Longstreet's Corps would have held the high ground to the south with open access to the road network to the East. (Next stop, Baltimore and Washington) The Union supply trains parked there would have been Longstreet's to take.  Under those circumstances Lee almost certainly would not have had Longstreet retreat and then re-deploy in order to attack the Union center as he did on Day 3.  (Imagine first and ten on the opponent's 20 yard line and then punting.)

No doubt about it, Joshua Lawrence Chamberlain, a born defensive coordinator, saved the Union flank and made victory at Gettysburg a reality

Eddie Rife sits in Cicero's

Eddie Rife sits in Cicero's office for nearly two hours discussing the facts of a pending criminal matter and seeking Cicero's "opinion" and someone thinks there is no attorney-client relationship?!?  A-C relationships have been established on far less clear cut cases than that.

Its pretty evident from the emails that the request for confidentiality Cicero made to Tressel made only to protect Cicero and no one else.

At a minimum, Tressel should have clarified why Cicero was asking for confidentiality.  Nothing suggests he ever did. 

Cicero seems a bit of a doofus. He contacts Tressel trying to prevent a scandal and instead ends up sticking Tressel's head in a noose. Cicero will be in some witness protections program for his own safety before the day is out.

Definitely.  The privilege belongs to the client, not the lawyer. The client can waive it.

I had exactly the same thought.

This explains why the attorney asked Tressel to keep the information confidential  This jock sniffing booster was probably Rife's lawyer. In one email ((4/16/10 at 224 pm) he says Rife was in his office because "He wanted my opinion yesterday on his situation.”  Bad grammar aside, that sure sounds like Rife was seeking legal advice from Tressel's pen pal.

It seems likely as not that the lawyer wanted to ingratiate himself with Tressel and so he divulged attorney-client communications.  But he did not want to get in trouble and so he asked Tressel to keep it quiet.

Tressel was not protecting his players. It seems more likely he was protecting an unethical lawyer.

Related question.  Under what grounds does OSU continue to keep this person's identity a secret?

 

 

1.  How come the tOSU

 

1.  How come the tOSU Athletic Department blacking out (i.e., concealing) the name of Tressel’s email pen pal?  What part of the Ohio Freedom of Information Act, (assuming there is one) lets them change a document that way?

2.  Who is the attorney who contacted Tressel last April?  Whatever credibility Tressel’s defense explanation excuse evasion deserves turns on the answer to that question

Tressel and Gee would have the world think this mystery attorney was working for the US Attorney or the FBI or some law enforcement agency and that is why Tressel had to respect the attorney’s request for confidentiality.

Bulloney.

There is nothing in the emails to suggest this attorney was anything other than a jock sniffing tOSU booster looking to ingratiate himself with Tressel and the program.  What is worse is there is reason to believe from the emails that this attorney may actually have violated client confidentiality when he notified Tressel. 

1.  In the first email, (4/2/10 at 232 pm). Tressel’s pen pal attorney never tells Tressel that he (the pen pal) is associated with law enforcement himself. He just tells Tressel that “a lot of my friends are in law enforcement”.  Supposedly, in the best case for Tressel, that somehow obligated Tressel to sit on the attorney’s disclosure.  Huh?!? The attorney does not even make any confidentiality request in this letter.

2. The second email (4/16/10 at 943 am) comes two weeks later and is even more damning for Tressel.  Attorney Penpal tells Tressel that Mr. Tatoo (Eddie Rife) was in the attorney’s office the night before spilling his guts to Penpal about facts that clearly establish Tressel’s players were violating NCAA rules. Attorney Penpal even tells Tressel he will try to get back the tOSU paraphernalia the gov’t took from Rife. (Though who he is getting the memorabilia back for – Rife or someone else -- is not clear.)  Penpal then goes on to tell Tressel that he (Penpal) knows the people in the District Attorney’s office who are working on this pretty well.

3. The third email (4/16/10 at 224 pm) seems pretty clear that Rife was talking to Attorney Penpal seeking legal advice. (“He wanted my opinion yesterday on his situation.”)

Whoa.  That takes care of Attorney Penpal being a lawyer for law enforcement or the Feds.

He ain’t.

And it sure sounds like Rife was consulting with Attorney Penpal seeking legal advice about a legal matter.  Otherwise, why is Rife spilling to Attorney Penpal? 

But the much more serious question is, why is Attorney Penpal spilling what Rife just told him to Tressel?   Tressel is not Attorney Penpal’s client.  (If Attorney Penpal were Tressel’s lawyer there would be a privilege for the emails he sent and they would never have seen the light of day.)

It sure looks as though at some point Rife became Attorney Penpal’s client and, if so, it sure looks like Attorney Penpal put his loyalty to tOSU football and Tressel before his duty to his client.  That could get his law license yanked.

Voila! 

There in a nutshell is the real explanation for why Attorney Penpal asked Tressel to keep it confidential. Attorney Penpal wants to dish about his client to Tressel, because that’s what jock sniffing boosters do, but he also did not want anybody to know he's dishing to Tressel about what Rife, his client, is telling him.  Doing that could get his license revoked.  So, Attorney Penpal asks Tressel to … keep confidential the facts showing his breach of attorney client privilege. 

And Tressel was only too happy to oblige.

Michigan slips into a bowl this year only by barely coming out on top of a couple of turkey shoots (e.g., Indiana) and a coin flip (e.g., Illinois)

RR ended tradition of excellence (38 top 25 rankings at season end  out of the 40 years before RR. None since.)

Michigan returning to said tradition of excellence nowhere in sight. (Not the offense. Please. Yards are not points are not wins. 7 points versus OSU is not progress.) 

RR is one injured Denard away from another 3-9 debacle.

RR ignores/neglects defense.

Agree absolutely.  Brandon's silence and lack of support can only mean Rich Rod is done. That is so obvious that it actually presents Rich Rod with an opportunity; courtesy of Dee Hart.

Rich Rod could point to Hart's defection to claim that Brandon's silence and lack of support is so negatively impacting Rich Rod's ability to successfully perform a core function of his job -- recruit -- that Brandon has already constructively terminated RR.  RR could resign, claim DB has made working at UM impossible and so, the argument would go, UM owes him the full payout due now, not the $1.5 mil less that would be due RR on Jan 1.

That way, RR could go out the way he came -- in court against his former employer.

As of today, Brandon has

As of today, Brandon has hired exactly zero revenue sport coaches in his career so any indicators of his ability to do that are all proxies from the pizza and coupon business.  Whether Brandon's acumen in picking pizza recipes or pizza executives translates to success running a major college sports program remains to be seen.

Certainly in neither of those  businesses was Brandon ever subjected to the kind of public scrutiny and vehement reaction he will experience with the first touch decision has has to make in this job.

A CEO in the private sector has the luxury of telling his critics to eff off.  Not so in this biz.  Do that in this biz and you'll get a Sunshine law demand for all your emails and phone records. 

Right now the only guy in the hot seat is Rich Rod.  If Brandon lets RR have a fourth year, and he goes 7-5 or worse (A real possibility. Sayanora Indiana and Welcome Nebraska) or UM gets pummelled again by MSU, OSU and Nebraska, then next year there will be two guys on the hot seat, Rich Rod for being a loser and Brandon for letting it happen and allowing another lost year.

So long as coach Jim calls Denard before calling a mere recruit Denard should be okay.  Especially if, in that first call coach Jim says to Denard something like this:

"Third place in the Heisman voting wasn't good enough for me and it won't be good enough for you if I have anything to do with it.  So, from one Michigan QB to another, Michigan's first Heisman trophy winner rushed, passed and kicked.  Michigan's next Heisman winner will rush and pass but I won't ask you to kick. (Though you can if you're any good)
