While going to law school in New Orleans, my friends and I used to frequent a bar called the Kingpin. We were there late one night, I think it was the weekend before Mardi Gras. My (admittedly hazy) recollection is that sometime around 2 am, the bar went from being mostly dead to nearly packed. Then one of my friends pointed over to the bar, where, lo and behold, Peyton Manning is sitting (alone), drinking an 8 oz. "pony" bottle of High Life from a bucket of ponies Kingpin had on special. Next we became aware that Eli was there too, playing shuffleboard with members of their entourage. This was immediately following the season where Peyton had set the then-record with 50 TD passes, so I drunkenly thought I would try to buy him a congratulatory Jager shot. I walked up to where Peyton was stationed at the bar, and ordered two Jagers. When the bartender brought them, I pointed to one and asked Peyton if he wanted it. Again, if my hazy memory is correct, he offered a dismissive response that may or may not have involved more or less than a grunt and wave of the hand. After leaving Peyton to his bucket of petite beers, while drinking my second of 2 Jager shots, I began to regret not mentioning the '97 Heisman vote.

after that, a 4 is more likely than a 2. i seem to remember seeing something in years past about how the committee generally doesn't have time to take the B1G tournament final result into account when determining final seedings. i don't have anything to back this up, just my flawed memory; but if my recollection is correct, then only if getting to the B1G final is sufficient wil we get a 2. i'm not optimistic this will be enough for us.

 

long story short, i'd say the odds are 75% for a 3, 20% for a 4 and 5% for a 2. what a world!

MVP is really a synonym for

MVP is really a synonym for "MVP on a winning team".  Given Hamilton's (mostly) comparable numbers, for a team which will in all likelihood win its division - combined with his greater contributions on defense, he is the best candidate this year.   Now, Delmon Young as a better candidate than Cabrera is ludicrous - his numbers, as a corner outfielder, just don't measure up to MVP-level.  Notwithstanding all this, I would rather have Cabrera on my team than pretty much any other player, which means more at the end of the day than MVP results.

i don't think

that's exactly what Obama said. my understanding is that he wants a justice with "empathy". in dictionary definition terms, this is: "the intellectual identification with or vicarious experiencing of the feelings, thoughts, or attitudes of another". i.e., Obama wants a justice who is open-minded and willing to consider all sides to legal arguments - along with considering the impact the ultimate legal decision will have on people in their day-to-day lives. i don't see anything at all problematic or unreasonable with such an approach.

attempting to divine the "framers' intent" is equally fraught with peril, in that they didn't share a cohesive, unified idea as to what the document they crafted actually meant. for example, consider separation of church and state under the 1st amendment. some founders, such as Jefferson and Madison, thought it meant a "wall of seperation" ought to exist between church and state. others thought it simply meant that the federal government couldn't declare an official state religion, but any state would be free to do if it desired. one could fairly argue that both views represent the "framers intent".

if there are

truly few limitations on federal government power nowadays, then please explain to me how a conservative-leaning court ruled against the Bush Administration's plan to try the Guantanamo detainees by military commission in Hamdan - in a "time of war", no less?

i will grant you that congress' powers under the commerce clause have greatly expanded beyond the framers' imagination. but then again, the framers' imagination consisted of an agrarian-based economy that was more local than global in nature. the times change, and with them the laws do as well.
