DB is bad but

The Toys R Us bk is happening because, as someone pointed out, a couple PE firms did a leveraged buyout a few years ago that saddled the company with tons of debt. Megadebt.

But if you look at the disclosures, Toys R Us is actually making a ton of money! In fact, the company will be fine going forward (probably), and DB will not get fired--he'll get even more bonuses! Toys R Us just needs to get out from under its debt obligations. Otherwise the fundamentals are totally there.

That said, Dave Brandon tried to ruin our athletic department and he should feel bad about that.

In defense of Dave Brandon?

As much as the guy ruined Michigan football, the Toys R Us bankruptcy is happening because private equity funds did a leveraged buyout a few years ago and saddled the company with tons of debt that it can't service.

If you look at the disclosures, Toys R Us is actually making a ton of money! Like, a lot of it! The company will be fine (probably) and Dave Brandon will not get fired (he'll probably even get a bonus!).

That said, Dave Brandon is bad and he should feel bad for how he ran the athletic department.

I was on an east coast road trip

checking out all the 'other' law schools. When I got home, there was a yellow packet and a letter from Dean Z waiting for me. And when I flew out to Ann Arbor, for some reason MLaw just felt better than other places. I'll always remember that feeling.

Congrats to all the undergrad admits today. And if you didn't get it this time, good luck in the regular cycle or as a transfer!

In my defense

Professor West taught the MPC pretty much exclusively, so I have a soft spot for it.

Also, I was on mobile, so googling MPC insanity was perfectly legit.

Legal Standard for insanity

The legal standard according to the Model Penal Code is that a defendant is not liable for their criminal conduct if, at the time he or she committed the crime, the individual suffered from a mental disease or defect that resulted in the individual lacking the substantial capacity to appreciate the wrongfulness of his or her actions or to conform his or her actions to requirements under the law.

So, there are a couple prongs here. You can have a mental illness such that you have no ability to appreciate that your actions were wrong. You can also have someone who knows their actions are wrong but, because of the mental illness, literally cannot stop themselves. In any event, it's actually a very tight standard. Criminal defendants never take the stand in their own defense, so imagine trying to prove that your client fits the standard for insanity. (As always, nothing on MGoBlog is ever legal advice.)

This isn't necessarily the law in Indiana but it's probably somewhat close. Different states developed their own takes on it. 

Logic

Looking at the contract language which, according to your post above, says something like:

"[O]ur Nike deal specifically provides for Nike to supply the football team with Jumpman gear IF Nike supplies Jumpman gear to other football teams that are Nike schools."

This indicates that if another program gets Jumpman gear, then Michigan gets Jumpman gear. It does not mean that should Jumpman supply Michigan Jumpman will supply other schools the gear.

It's a small matter, but I just wanted to point out that I think we were confusing necessary and sufficient conditions.

Is an Ohio win good for the B1G, but bad for recruiting at M? Or does HARBAUGH! trump a spot in the championship--assuming Ohio makes it there?

The reason to leak

If you're Michigan it seems to me a leak would benefit your position by bringing this publicity storm down on Harbaugh.

If you're on ESPN, and friends, family, and alumns you played alongside start calling you, you have to listen. They all want you to make a decision to come home, and it becomes difficult to resist that.

You have to win hearts. Harbaugh can get money anywhere. Plus money doesn't seem to motivate him, based solely on the crazy speeches of his I've read.

I have a new professor who is

I have a new professor who is great. St. Antoine is the man. He came in and taught a section of the class even though he's ancient now. He definitely still has it. 

Exams as a 3L are the worst.

Labor Law

So, I'm a UM law student avoiding studying for my labor final. For what it's worth, unionization doesn't necessarily--or even likely--lead to paying money to players. It merely provides the framework for forcing management to the bargaining table. It seems like players want more autonomy to pursue athletics and to have more of a say with their own safety. Seems like a good idea to me, considering Morris-gate 2014.
