That picture you posted of Brandon's snarky email; if this plays a small part in a storm of embarassing press and somehow goes viral, leading to further egg on the faces of the atheletic department...

How will it make you feel to have made a small but very significant contribution to the ouster of Dave Brandon from the athletic department?

if we deleted every thread that wasn't confirmed, this time of year the mods would have to delete damn near everything.

The source was clearly labeled, so people could adjust their grain-of-saltiness accordingly. And while no one could confirm the exact details of this one, sufficed to say (and without going into too much detail) that the email is consistent with prior behaviors.

I got email confirmation that my FOIA request had been received Saturday just after 3 pm.

I'd emailed President Schlissel's office at lunchtime Friday to notify them of my pending FOIA request, and to ask them to put a PR professional in charge of vetting any email sent from DB's uniqname if there was any chance my FOIA request would not come back empty.

I have not received a form response to my email to President Schlissel's office; I assume it will get a somewhat more personalized response in the next day or two. (That's usually what happens when I send a spicy email to that office in which I actually make a good point.)

What's your optimism on getting your FOIA request fulfilled in a timely manner? I thought they could take a looong time with these before you can even protest the delay. 

I'm friends with the dude who is, according to the DOJ, the "most prolific" FOIA requester in America. He works out of MIT and is a great guy. I suppose I could ask him for advice if you run into roadblocks.

They didn't confirm receipt of the request on Friday despite the fact that I sent it Thursday evening, but I got the confirmation of receipt on a Saturday (so outside business hours) from a person whose job I would not expect to require being at the office on the weekend, a little over a day after I emailed President Schlissel's office and mentioned that I'd sent the request in. To me that says his office has someone checking on the situation. That could be overly optimistic, but who knows.

FWIW, I replied to say thanks, that I assumed that they'd received the request on Friday (she said she hadn't seen my request to confirm receipt at first--another sign that her attention was drawn back to it over the weekend, since she must've looked at my email again on Saturday for one reason or another), and that I'd expect the documents by this coming Friday (which is what the law more or less requires).

Now, they get 5 business days, and I could see them claiming receipt was after 5 pm Friday (though I don't know how that could be true, and her confirmation email was clear that she had initially received the email some time prior to confirming receipt), which would give them until next Monday. They are allowed to give themselves 10 extra business days for difficult-to-fulfill requests, though I don't see how what I asked for is complicated to gather. They are not allowed to take longer than that. So Oct. 27th is the absolute latest they can legally fulfill my request.

But if I don't have it by the end of business this coming Monday, I'll have to assume the search did not come back empty, and that they are taking their time editing out the names of senders of emails and the like. Should we get to that point, my further reaction will be governed by what I have heard from President Schlissel's office or other parties in the meantime.

To be honest, now that I think about it, I might make a giant sign for the Penn State game, requesting that they fulfill my FOIA request by Monday as the law requires, if I don't already have the documents come game time Saturday.

is it different wrt to government agencies?

I always had the impression that my friend faced long waits for each file he requested, but that he had such a massive rolling wave of requests, that he could afford the wait. 

I had no idea it was this fast for academic institutions. 

If they delay, are you prepared to take legal action? 

Because this would not be good for them if it gets confirmed, and I can't imagine Brandon just willingly giving up something that will burn him with the regents.

I think of FOIA as only applying to government agencies, but I suppose publicly traded companies also have some obligations. But IDK. IANAL, and I've never done this before. 5 business days + a 10 business day extension for complicated requests is how FOIA law works in the state of Michigan. But I only know that from Google.

This is not in Brandon's hands. He doesn't oversee FOIA releases, and UM has bigger problems than we all think if he can personally obstruct them.

Re: legal action: I have lots of lawyer friends, but I love Michigan and have every confidence in the people who run the place (at least, outside of the current AD administration). I do not expect to have to make any decision about legal action.

Publicly traded companies is a totally different area of law - securities regulation.

IANAL, but I do have a law degree. This is not my area of expertise or even passing knowledge, though. 

I will be very interested to see how this turns out. Forgive me for thinking you won't receive anything but a page of black boxes!

Honestly, it isn't very funny.  You posted a completely unsubstantiated smear piece on our AD that made a national news outlet and embarrassed our program. Sure, they get some blame for sourcing it, but so should you.  If the FOIA turns up nothing, you hopefully won't be allowed to comment here ever again. If it proves you right, this post will immediately self-destruct.

I find it revolting if you made up something that costs someone their job. They can lose their job on their own merit (or lack thereof), however to make up something or publish something as fact when you don't even know if it is, is spineless and pathetic.

A few people on here actually FOIA'ed it - there was some behind-the-scenes controversy as well regarding it, but the end of the discussion was that it would stand because there were reports of similar incidents and also in the event was verified, or at least that was my understanding. I admit to being the mod that felt uncomfortable about it remaining up while unverified, but the Mod Sticky gives a brief overview of what happened next.

And I'm just giving them crap because I threw a fit a long time ago about why we should be expected to give a shit about what BiSB thinks when he wasn't, IMO, a bonified expert, and then Brian basically called me a dick on the frontpage without using my handle.

Anyway Brian and I (and LSA and I, for that matter) shook hands at some event after that. Or maybe before that. But in my mind we have forgiven each other so let's pretend it's ok.

ETA: Most of them also have my real name because I've emailed them using it at various points. But really I just meant "Jon06" because I hope to one day be e-special on the interwebs.

Ah, yeah, I knew when the event was, I just didn't remember when I threw the fit. I guess it must've been over the summer before that season, then.

I feel like they're in violation of the law if they routinely give themselves 10 extra days for every request. That would be disappointing.
