OT: SEC Digital Network vs Blogging and live streams

A very interesting article in the NY Times yesterday. The SEC
"has issued rules in the past week prohibiting fans from distributing photographs or video of its games in real time for commercial use."
So what does commercial use mean?
"The rules are aimed not at the casual fan who might post a few pictures of Saturday’s football game on a personal Web site, but rather those who copy television broadcasts, create their own highlight reels and post them on sites charging for access or advertising."
Key word: Advertising! Does that mean if BTN implemented the same rules, MgoBlog's current setup would be illegal...
There are a couple of more interesting quotes in the article from various people involved such as the major newspapers/magazines whom have all taken the Bloggers side.
Also, seems as if a "live blog" or twittering pictures from practice is what their most concerned about. Would what annarbor.com does with some amateur video at practice be illegal?
I'm drawing some conclusions, but I'm not sure if their right. Check out the link, and provide some feedback...

I would definitely like to hear some thoughts on this as well. It sounds like there are a couple of grey areas, judging from the quotes.
