New England Patriots issue rebuttal

This story isn't going away. I think it is the dumbest sports story I can remember but after those assign penalties were levied on Monday I wan to see the NFL embarrassed in a courtroom.
The New England Patroits have created a website and have put out their rebuttal to the Wells Report.

You know what I actually think this story is much dumber as it is way overblown by every media outlet there is. This story grew so fast and big I was shocked. Stretch gate was simply one idiot trying to make a name for himself

The author of both stories is the same person. Mike Rosenberg was the guy who helped brake stretchgate. He works at SI now and posted the original deflategate allegations because he has no integrity and doesn't care what he has to destroy to get a story.

Looks like an impressive reply, I think - tldr, and their own website, wow!  Would have been just as effective to put this on the website as a rebuttal to the NFL....

NFL's new Game Ball Protocol.  Such as (1) Everybody plays with the same ball, so do what ever you want to do  with it because the other guy is using the same ball or (2) Inflate your team's ball to what ever pressure level that you like and the opponent will use whatever pressure level that they want to use. Either one is better than the current rule and easier to enforce.

Just a quick, semi-OT story...

I have a "friend" that was an equipment manager at OSU when Herbstreit was their QB. Evidently, Herbie has really small hands and had real trouble gripping the ball. Before every game, they would use sandpaper to scuff up the balls to try to aid his ability to grip the ball. According to my friend, his tiny hands were one of the reasons Herbie never got any interest from pro teams.

which isn't new for them but still. They had almost decent circumstantial evidence and Robert Kraft was pretty much going to just take the fines or penalties if they were reasonable, but the NFL took this cooked up report full of holes and countless assumptions and too a huuuuge swing for the fences with their penalties. 

 

Their rebuttal is already done better than the Wells Report was and I really hope Kraft is serious about fighting this. If he takes them to court, it will either be a super quick settlement with the NFL lowering all fines/suspensions/penalties or he will win. Having read both almost in full now I really don't think a neutral judge could actually side with the NFL here.

The Wells report is a thesis intended to find the Pats guilty, and then selectively collecting evidence that supports their original claim. If Wells was so confident in his report then he wouldn't have to come out to the press. But the fact that he's publicly claiming that the report is fine, clearly shows he has many insecurities with it. He was basically paid $5 million by the NFL to prove what they wanted him to prove.

Agreed.   I love how Wells discounted the Anderson's recollection of which gauge he used (the discounting of which conveniently supported the NFL's assertion of deflating) but relied upon his recollection (of the same event) of what the psi of the Pats' and Colts' footballs were pre-game

That really should be enough to overturn the suspension by an indipendent arbitrator when it gets to that point.  Especially considering that if you assume Anderson used the gauge he said he did and if you account for the Colts footballs being measured at the end of halftime when they had a longer time to warm up and add psi, the entire difference in psi loss between the patriots' footballs and the colts' footballs is negated.  

Without that one presumption, of which there is questionable basis, there is no evidence of any tampering at all.

Sadly, I doubt many haters within the League offices, the Media, or opposing fans will read it. 

But it makes me smile to see a team refuse to kneel and kiss the League's ring. 

This rebuttal a great start.  Interested persons should read the rebuttal--it's just amazing what the League is trying to do.  It's a Banana Republic, and Goddell is military dictator.

If Brady or the Pats can get an appeal before a truly neutral arbitrator, the likelihood that the league wins this one is really low.  The league has the burden of proof.  Hard to see anyone neutral saying that they met it--not to mention how grossly excessive the penalty is even if there was an effort to deflate the balls.

First of all, why would they bite the hand that feeds? Second, can they? Kraft is angry right now, but Kraft IS the NFL. And the NFL distributes a lot of money to Kraft. This is not a precursor to a lawsuit by Kraft, it's Kraft sticking Goodell's nose in it. Tom Brady, on the other hand, will probably sue the league after the union appeal is over.

that Brady didn't do it and there isn't a smoking gun out there to be found, I hope he sues for defamation of character.  I would say at this point that several millions of dollars of damage has been done to him, easily.   In fact, I think you could easily argue for a double digit millions lawsuit.

If it gets that far, and it won't, Brady will have to turn over his phone and emails during discovery. It's not going to get that far. He will push for an independent arbitrator, he won't go beyond that.

It's rivaled only by stretchgate/Freep's jihad. But since this is a much more national headline involving a hall-of-fame QB who just won the superbowl (you know, the single most watched sporting event in this country), it elevates the dumbness to a whole new level. Not to mention taht at the very least, stretchgate turned into you basic slap-on-the-wrist punishment. What makes deflategate even dumber is Goodell gave into the PR pressure and handed out a comically dumb, insanely ridiculous punishment. Somehow he made the issue even dumber than it already was. And the story won't end because of that. Which is perhaps the dumbest part of this thing...it would be done with if they gave them a paltry fine and moved on. But no. They had to make an "example" out of the Patriots because they know it will make them LOOK tough without actually being tough (and they also know that most of the country hates the Patriots).

When the worst thing you can say about the infraction is "But...he cheated!" (which I'm not even sure was really proven even by the circumstantial evidence in the Wells report), to then levy ALL THE PUNISHMENT is, frankly, absurd. It's like sentencing someone to jail for 25 years for driving 5 over the speed limit in an area that had never been monitored before. Then saying "Well, you deserve it because you BROKE THE LAW." And then bringing up an incident that happened 10 years ago to call it a "pattern of breaking the law." Because "PATTERN OF CHEATING" sounds a hell of a lot worse than "probably deflated a few footballs maybe 0.5 psi below the league minimum, which looked a lot worse because the ideal gas law caused further deflation of 1 psi during the game".

The bottom line is the NFL is insanely hyprocritical. On one hand, they clearly did not care about this AT ALL. See: previous incidents where actual provable tampering with footballs resulted in a small fine or less. Plus that game Brady was mad at the refs for overinflating the football SHOCK HORROR 2.5 psi above the league max. And then being SO CONCERNED about the whole thing that they...barely even did due diligence at the time it occurred to measure all the balls (oops, no time I guess!). Or didn't even bother warning the Patriots that they were going to monitor it more closely before the game.  So on the one hand, they clearly didn't care. But then, what does the punishment do other than send the signal that the Patriots just cheated in the most nefarious of ways possible? These messages are clearly in direct conflict with each other, and I for one am happy to see the Patriots fighting the league like this.

This is so dumb that it makes the word dumb look dumb.

I have been following the comments from people all across the internet on various articles and message boards.

Public opinion seems to be roughtly about 65-35 in their opinions that Deflategate is justified.

This pretty much supports my own theory based on 45 years of reseach that about 65% of the humans in America, (and probably the world) are complete Dumbasses who you should never trust. 

To be successful in life, one needs to be able to identify this 65% and weed them out of your life as soon as possible.

Which is why I visit mgoblog often. Now, that percentage isn't 0 here, but it's significantly lower than 65% that's for sure. 

Everytime I hear a local sports guy (I live in Oklahoma,) talk about deflategate and how "THEY CHEATED" and all this stuff about how they deserve it and blah blah blah...I just...can't. I feel like I'm taking crazy pills. What is wrong with you people?!?

I thought that Roger Goodell was public enemy number 1 right now for Patriot fans but I think Mike Silver may have joined that territory. If not 1 then a close 2ab. This guy is relentless with his one sided, biased arguments. He's defensive of the NFL till the end and even if counter arguments are readily available and objective he immediately dismisses them and makes the same snarky comments over and over. If I remember correctly he was one of the most outspoken writers on Harbaugh staying in the NFL and there's 0% chance he goes to Michigan. He's unbearable right now and I'm gonna compare him to Tim Kawakami during the coaching search. Just blocking anyone on twitter who questions him and calling people names. He's a child.

Now to the report, It single punch knocks out the Wells Report's 'science', and it does a good job at bringing a lot of doubt to the holes that are all over this hilarious 'investigation'. Where it goes wrong obviously is the explanations of the text messages which if you've been on twitter today, that's what every media member defending the NFL is focusing on. There is no use harping on this issue because a minor speeding ticket/warning has become a felony and it's a complete waste of time. 

Where is the NFL's investigation into Rodgers and the Packers? Inflation is the same 'competitive advantage' as deflation, right? Not sour grapes, It's about the integrity of the game, right? Where's Mortenson been in all of this? Still waiting for him to give his source. It has gone so far away from that and now it's about bringing down the premier team and player in the NFL just because. 

I can't wait till Kessler and Yee (Brady's lawyers) make the NFL look silly and Brady is playing on opening night! Also, Goodell will be kneeling at Kraft's feet for forgiveness after all is said and done here. Pretty much, I am gonna feel the same satisfaction as I got when Harbaugh came to Michigan and made all those 'experts' go on damage control.

In summary the NFL used one gauge to measure the Colts balls and a different gauge to measure the Patriots balls for official purposes. Even though the Patriots gauge also measured the Colts balls at a lower psi? Hmm...

only the pressures that make it appear that the Patriots were deflating their footballs. 

But when it comes to the Colts' footballs, they report only the higher pressure readings from the second pressure gauge, making it appear the Colts' football pressure didn't decrease as much.

The NFL is a Banana Republic, and Goodell is the military dictator.  They take measurements with multiple pressure sensors, then mix and match data to "prove" the outcome they're aiming at.

And only measured 4 Colts balls compared to 11 Pats balls. Hmmm... No numbers recorded before the game..  How do they know that the range of PSI drop of the Pats balls does not fall within the Ideal Gas Law but all of sudden they know that the psi drop of the Colts balls does? That does not make sense.

Based on the data and scientific analysis, it's essentially impossible for the Patriots to have committed any significant tampering with the football pressures.  Even if the equipment guy came out and stated he deflated the balls, it wouldn't make any sense.  If that was his job, he either didn't do it or did it completely half-assed.

And the report was ginned up to indict the Patriots and Brady anyway.

And then there's the matter of selective enforcement.

This whole fiasco basically crapped on the image of the NFL, its premier team and its  premier team... for no reason.

How does Goodell keep his job?

Did you see the cover of Sports Illustrated? It features Harbaugh, but in the upper right corner it says, "Deflategate: The end for [Brady crossed out] Goodell?" I really think this might finally do Goodell in. And good riddance.
