McQueary may have stopped the assault AND went to the police

Submitted by coldnjl on

Apparently he will be on CBS tonight. Emails obtained by a news outlet authored by McQueary says that he did stop it and went to the police...

In the email obtained by The Morning Call, McQueary wrote that he "did have discussions with police and with the official at the university in charge of police" following the alleged incident between Sandusky, a former Penn State assistant coach, and a boy. McQueary also wrote that he "is getting hammered for handling this the right way or what I thought at the time was right."

I hope this is true for his sake

Schultz.

Also, as a former prosecutor, I can tell you that not every fact is in the grand jury report.  I can't quite speak to how the process works in PA, as I worked as a DA in Wisconsin, but I can tell you that you don't need every fact in your complaint, and you don't want to flush everything out for a felony prelim hearing.

If mcqueary talked to the cops, there would be some evidence of same: a police report, etc. Regardless, I what he says is true, it's even worse for Joe because it affirms that McQueary complained and Joe did nothing.

If normal procedures were followed you'd think there'd be some record of the visit or phone call, but how do we know normal procedures were followed? Maybe the report was never filed. Maybe it was filed and later lost or destroyed. Maybe the case was immediately bumped to Schultz's office and the initial officer never even knew what it was about.

There are endless possibilities here, most of them seemingly unlikely but what about this case is likely? A lot of people are stating things as absolute certainties that they can't possibly know for sure.

Victim 1 is what got the ball rolling on this and there is plenty that can be verified by him, his family, coaches, teachers, and administrators.

Victim 2 is just what ties this horrid affair to PSU.

What if the police investigated, and all they got for "evidence" was "he said, she said?"  Without the testimony of a victim, would a presecutor even think of trying the case?  And if the police didn't give any indication that they believed it, why should Joe?

What if this turns out to be Duke Lacrosse, V2, but with a lot more carnage?

Sandusky has admitted to repeatedly showering with underage boys. Isn't that all by itself a crime for multiple reasons? How is it any different than exposing yourself on a school playground to small children?

Is first of all, why did Ray Gricar decline to press charges in 99? The DA always prosecutes cases like this. I think a lot of people are starting to wonder where he went, because right now his mysterious disapperance is looking like a major cover up. I have a feeling we haven't even begun to scratch the surface yet.

McQueary's testimony isn't really necessary to convict Sandusky.  It is, however, key to convicting the other PSU officials on perjury.  If he's now making up some self-serving shit, it might just allow the others to skate on their perjury indictments.

The facts, I believe, will come out.

I will keep this post short, but imhe, Paterno is still completely to blame, McCreary, less so. There is a good read on this at ESPN, link:  http://espn.go.com/espn/otl/story/_/id/7237700/in-penn-state-child-sexual-abuse-scandal-there-no-easy-answers-assistant-mike-mcqueary.

In short, I can easily believe he was in shock, the anal rape stopped, he reported to his supervisor, he reported to the police, and the police, Paterno, Univ. Admin, all said "thank you, we're taking care of this now . . . you don't need to do anything else."

I can't help thinking of an old Harrison Ford movie "Witness." When corruption is wide and deep, you are royally screwed in trying to get something done when you are inside and part of an organization.
