So says a OSU poster on the Ozone board. Can't wait to hear Gene Smith tell us this is just another "isolated incident."

I wish we could just ship those cheating cooler poopers off to the $EC where they belong.

Naw they're right.  I live in Perrysburg, it's a nice little town but the police are all douchebag dickheads.  Even the speed limits are set up for traps, you can be doing 50 mph over the Maumee River bridge and it slows to 25 really quick.  

I've heard of stories like that and it doesn't surprise me anymore.  If you have to drive through Perrysburg, just BE CAREFUL.

He was in the parking lot of an establishment that shared a lot with a few other places. Other cars were in the lot and he actively decided to NOT possibly hurt others. Imagine how bored that cop must have been. He admitted to everything, blew less than a .09 (!) and was even told that despite crawling in the back seat, his keys in the ignition = drunk driving. He said he forgot them in the embarrassment of realizing he drank too much. He considered a cab and hotel but the cab had a wait time and he'd have to drive to find a hotel. Taking time to sober up before driving cost him a job and more. Just seems crazy to me.

No. Not the law everywhere.

I'm a DUI lawyer, and I can tell you that some states require volitional movement of the vehicle, while for others, "driving" can be just sitting in the driver seat and operating some function of the car such as putting the keys in the ignition or even less.

I think it is law in Ohio and I understand wanted to keep folk from sleeping in cars everywhere/drinking and sleeping but another couple of hours and he would have quietly gone home. It just seems like a crazy law considering he wasn't parked on the street, etc. To think he'd only have gotten worse if caught driving somehow is crazy to me. I think I'd throw a guy like that a warning if I were a police officer. I dunno...

If he got charged in Perrysburg, the judge for that district is a real prick.  There is no way he was getting off.  Pretty sure the judges daughter was killed by a drunk driver.  But I've also heard stories of him getting pretty drunk himself and getting a police escort home (from a friend's sister who used to be a cop in Perrysburg).

Keys in the ignition was the mistake. Had a cop tell me back in HS that even if the car is parked and off and you're sleeping, if the keys are in the ignition that's all the proof they need for a DUI. Throw the keys on the floor and sleep in the back seat and you'll be fine.

Don't rely on the gender/weight/drinks-per-hour tables. They just represent averages that actually vary materially for any given individual's circumstances. You might be a .03 on the table, but due to sleep, food, and unique personal physiology, .07 in reality, and due to smoking, the rate of breathing, and machine margin of error, a .11 in a live field breathalyzer. In short, it's really hard to actually know or estimate breath-measurable B.A.C. without actually taking a breathalyzer. Don't rely on the tables, and if you have more than one drink, don't drive at all.

Here's a government report discussing different types of tolerances and different effective functioning levels at equivalent B.A.C. levels: http://pubs.niaaa.nih.gov/publications/aa28.htm Again, alcohol, it's functional effect, and the ability to anticipate the effect of a drink for a particular person at a particular time are all highly-individualized issues. This is unfortunate, as it's difficult to develop reasonably-accurate proxies for safety on an age/gender/weight/drinks-per-hour basis.

I can't believe that anyone who has ever had a drink with a friend who didn't drink much would believe this.

My friend's ex was hammered after a wine cooler, sluring words and suffering obvious functional impairment.In a word, staggering. I do not slur words or show impairment after 2 beers and I weigh less than twice of what she weighed,

That statement is ridiculous.
