Seems to me it's a clear case of B&E. He should have been taken in just like any of us would have.
I will bet dollars to (hur!) doughnuts that the doors were unlocked and there were workers in the back getting ready to make the morning's first batch. He wanders by, stoned out of his mind, and sees a light on in the back of the kitchen somewhere, tries the door and finds it opens, enters, and then starts a drugged out rant demanding doughnuts.
