Beaver: Hackett taking a run at Harbaugh through the 49ers

Don't want to start a new thread for this but over on Scout board, (GBW writer Tom) Beaver claims that one of his sources has a friend close to SF situation that Hackett will be making a major move for JH "through the 49ers". It would be bigger than what we would've thought was possible.

I don't know enough about the specifics of NCAA/NFL relations but

1)  Why would we even need to talk to the Niners about this.  Michigan isn't part of the NFL.  Harbaugh would be walking away from his contract to come to Michigan.  We don't need "permission" to talk to him.

 

2) What could we legally offer San Francisco anyway?  Can Michigan, as a University, give them cash for Harbaugh?  Is that even possible?   I guess I never even thought of that.  It's not like Jim is a player.  We are talking about an employee here so I guess we could theoretically do anything..  Are we talking about buying him out of his deal?  If so, why?  Why not just have him cut bait and walk away?

You cannot techinically trade a coach in the NFL. What you can do (and has been done in the past) is send compensation to another team in exchange for them letting their coach out his contract. If Harbaugh is "traded" to another NFL team, then he will be released from his 49ers contract and will need to sign a new one with the team that traded for him. The 49ers really have no leverage because another team is not going to give them anything without an agreement with Harbaugh.

I know I'm thinking the same thing to all these people saying "he can just walk away!". I'm pretty sure he wants that buyout money.

 

And IMO, if any of this is true, Michigan is routing this through the 49ers and paying the extra $$, simply for the reason that if they don't they could get easily shut out by the 49ers/JH signing off on a trade deal to another NFL team before Michigan has a chance to do anything about it. If they include the 49ers in their negotiations, although more expensive for Michigan, it makes it much easier for Michigan to get what they want (JH).

It's no risk to Michigan to speak to Harbaugh, per se, but it is a risk to Harbaugh if that would result in his termination before he's ready to ink the deal.  If Harbaugh has his mind set on leaving San Franciso already, though, we don't need permission and the 49ers can pound sand.

Maybe this means he can get Harbaugh to Michigan earlier than expected b/c the 49ers want to make a change anyway?  And if the 49ers "fire" Harbaugh, and he's getting $7 or $8 million from Michigan, the 49ers won't have to pay him for the rest of the contract.  And for those who don't know how these usually work, if you get fired you still get the remainder of the money on your contract UNLESS you're working somewhere else, in which case the firing party only has to pay the balance or maybe doesn't have to pay at all.

In terms of compensation, Jabrill Peppers has a lot of upside, and he could really interest the 49ers. Perhaps we could throw in a guy who could bolster their interior along with Peppers, and a 5th round pick? I could see San Fran taking that as a starting point for a trade parameter.

We could pay the rest of his contract. This way San Fran would be okay with letting him go and get 5+ million in return. If any of this is possible. That's what could happen. I'm just throwing a dart here.

I thought the same thing, however, there is literally nothing we could work out with the 49ers that puts Harbaugh under contract with us.  He would have to sign an employment contract with us under any circumstances.  So maybe, the deal would be that SF fires him and we agree to pay Harbaugh whatever he is owed under the terms of his contract with SF provided that he signs with us.  That way, SF owes nothing further to him if he returns to college for a period of time.  Plus, SF doesn't have to worry about him going to another NFL team and winning right away.  Interesting.
