Day Of Legal Fun Continues: Frank Clark's Turn
Zero details on this yet but a Frank Dominick Clark shows up on a 14th District Court preliminary exam list with a charge of "Home Invasion" in the second degree:
CLARK, FRANK DOMINICK
PRELIMINARY EXAM - JG SHELTON
LEWIS, DOUGLAS E
HOME INVASION - 2ND DEGREE
Slight possibility this might be some other Frank Clark—google did not turn up confirming evidence of his middle name—but there were some rumors going around some weeks back about Clark being in some sort of trouble so the chances this is a mixup are very low.
The charge is serious…
(6) Home invasion in the second degree is a felony punishable by imprisonment for not more than 15 years or a fine of not more than $3,000.00, or both.
…but is probably similar in nature to the Marvin Robinson issue that drew an identical charge and is in the process of turning into a misdemeanor of some variety.
Frank Clark is accused of stealing a MacBook Air from Stockwell Hall, according to police.
I don't think he should have allegedly done that.
I don't know. But we are 5 months away from the end of the world.
We possibly lost 2 starters...
At least Clark was still number 2 at WDE going into camp. Beyer started the spring game and Mattison talks very highly if him.
Oh Bob Saget!
I guess that means Beyer is the new WDE.
He has been. Him and Clark would have been splitting the plays this year. But now it's Beyer and who knows at WDE until / if Clark comes back.
Last year Roh was the WDE so Beyer has not been the starting WDE. Based on projections out of spring practice he was a nose ahead of Clark to be the NEW WDE so my original post is correct.
I understanding what you are saying now. I think your wording could have been a little more clear, but I get you now.
Looking back, yes.
I thought the WDE competition was going to be the closest position battle in fall camp but this news changes that.
This is worse. Home invasion is premeditated.
And drunk driving isn't?
Sometimes guys feel fine, but their BAC is not. Not necessarily premeditated, but still stupid as all get out.
This is the worst birthday ever...
Same here MGoBirthday buddu
And, yeah, I sure didn't see this coming ...
Um this is serious stuff if true.
Home Invasion in the Second Degree - MCL 750.110a (3)
Second degree Home Invasion is another Michigan felony and it is punishable by up to 15 years in prison, a fine of up to $3,000, or both. Michigan Home Invasion in the second degree is similar to Michigan Home Invasion in the first degree, with the difference being that the third element (involvement of a dangerous weapon or someone lawfully inside the dwelling) need not be met. Therefore, a defendant can be found guilty of Second Degree Home Invasion in Michigan the prosecution can prove the following two elements:
(1) The defendant must either break and enter a dwelling –or– the defendant must enter a dwelling without permission.
(2) The defendant must have formed the intent to commit a larceny, felony, or assault by the time he entered the dwelling –or– the defendant must have actually committed one of those crimes while entering, present in, or exiting the dwelling.
If just one of these elements cannot be proven by the prosecutor, the defendant cannot be found guilty of Home Invasion in the second degree.
Probably serious, probably bad.
On the other hand, the Furman thing basically started with the accuser claiming "this guy barged in here to beat me up," which would qualify as a home invasion in the second degree.
Until we know more, we don't know much.
Time for a team meeting to discuss the expectations and goals for this season.
This is inexcusable.
Goals and expectations for the season?? Pretty sure not breaking the LAW should be an expectation no matter what time of year it is.
It better be a very short, very loud meeting. This shouldn't be a difficut concept.
But I'm not mad; I'm disappointed. What these kids are doing have much more effect on their lives than ours (I know, I know it sucks for us, but going to jail is worse than watching your alma mater lose a few football games), and it makes me sad that they are putting themselves in bad situations. This ship needs to be righted.
Hopefully they can turn this thing around soon.
With Home Invasion of any degree, if this sticks his ass better be off the team. Invasion means he was going to commit a felony or performed one to get in, which in turn generally means guns and/or assault.
Wouldn't that (using a weapon) be part of the charge or the description? He could have easily said the words "open the door and give me your lap top" and those words could also be considered force as well right?
Either way, this is not looking good for Frank. i'll echo my previous thread:
Mr. Clark, you're better than that.
with the caption:
STOP BREAKING THE LAW ASSHOLES!!!!
"We are aware of the case ... This is a serious accusation. We will follow the lead of the judicial system. Frank was and will continue to be suspended pending the outcome of the investigation.
Finding out the starting RB and extremely promising sophomore are in trouble with the law on the same day.
Try to find a video of the Barry Larkin HOF speech. I think that would be refreshing right now.
all the DUIs going around, in the NFL and College. I was broke in college and I found a way to take cabs.
Especially confused by the NFL dudes getting them, shit, I would be getting hauled around in giant party busses every time I wanted to get crazy.
Confused Wolverine Fan
Where do these guys live that they even have to drive? Don't most athletes live on campus?
Well, we officially are no better than any other school. This is embarrassing.
I don't care what Hoke does - it's his team. However, I want something public said. There needs to be a public statement of some kind that is more than simply what the punishment will be.
Obviously, Hoke is going to verbally kick some ass in the locker room, but if he doesn't come out publicly with some kind of statement we will continue to get our asses kicked in the media.
Well, at least there's a built in excuse for the outcome of the Alabama game.
You sound like an SEC troll
Nice way to get your first mgopoint.

Great so he will get kicked out of um, go to jc for a year then enrol at Auburn and become a all American and #1 Draft pick?
enroll at Auburn
Only 2 steps to making money @ Auburn if you play foosball...
1. Enroll at Auburn
legit and he broke in with a goal of stealing a computer, he should be off the team. IMO
If he really did steal a Macbook from a dorm... kick his ass off the team.
There is nothing more blatant than stealing a laptop from another student's dorm room.
It isnt an accident... It isnt an excusable mistake...
It absolutely infuriates me to think that another student has to worry about a football player (who is supposed to be a public example of Michigan's ideals) has to worry about a laptop being stolen..
I dont even care if its not a second degree home invasion... If you steal a laptop from another student, you are a piece of shit
If he really stole a laptop, then why isn't he charged with it??
Well, unfortunately that only tells us so much. Is this a case of him actually breaking into a random person's room and stealing their laptop, or is this a friend whose laptop be borrows on occasion and this time he did so without asking because he thought his friend wouldn't mind?
M-Rob was accused of breaking into a house and stealing an X-box or something, when it turned out to be his old roommate whose X-box he used to borrow all the time. Hopefullly this is more like that sort of thing than straight up theft.
But that guy on State's team stole like a hundred laptops and he's still on the team so who knows.
Yeah, I could have used some strong language and unwarranted assumptions (at this time), but stealing is such an enormous pet peeve of mine....
If it is true, though, I just would be absolutely furious. As a college student, a Macbook is sometimes the biggest purchase of a kid's life and his/her most important belonging.
I will definitely wait until the court date before I make my judgment.....but why are our players always getting in these 'misunderstandings'???
I cant name anyone other than Furman, Robinson, and Clark that have these odd 'friend' relationships that end up with felony accusations.
Yeah, you kinda jumped the gun on this one. Unlike the Fitz issue, this is not very black and white. I'm not saying that this "misunderstanding" didn't involve Clark being a total idiot, but it's very possible that there's more to the story than someone getting their shit ganked. It could be that this is more of Clark being a dick than a thief.
I had a buddy in college who lent his gf his ipod (when these were brand new and not many people had them) and when they broke up she was being a bitch and wouldn't give it back so he called the cops on her. She was being a bitch, he overreacted, but for all intents and purposes there wasn't anything criminal going on.
There is clearly more to that story. I assume Stockwell is still a girls dorm? Who (what sane player) would ever steal a computer...especially from Stockwell.
I can (I'm sure we all can) think of the only scenario where boy takes girls computer and girl says give it back or ill have you arrested.
Stockwell is now coed.
I trust coach Hoke to take care of this in a proper and fitting manner. He has not let us down yet. I think he handled the Stonum situation perfectly, didn't let him play but gave him an opportunity to earn his way back onto the field. I expect Fitz will be off the team until the completion of the legal process regarding his infraction. Then he will have to deal with any team punishments Hoke has. Clark too.
Remember, no man is more important than the team. No coach is more important than the team.
Is he a sde type or wde?
