no, this would be like mccain winning the election, and then dying, and then palin becoming president, for whom no one voted. your analogies are all terrible, mostly because they are not backed by research and lack critical thought, so i had to correct them.

Yeah ... I liked the other banner. A lot. In fact, I think I voted for it. But as a photographer, if the banner creator didn't first seek permission before using the photo in such a public manner, I can understand the photographer's reaction. If I found my work being used in this sort of manner without prior permission, I'd probably be kind of irritated for a while. I'd also probably grant permission for the use (as others noted, marketing is good), but if it were done without permission, yeah, I'd be irritated for a while. My images are all I have, and it's in my best professional interest to know what they're being used for.
So yeah, I know posting on Flickr isn't the best idea if someone wants to protect his images, but that doesn't negate the minimum courtesy everyone should have to take a few minutes and ask for permission first. Seriously, it's the right thing to do. Remember: things aren't in the public domain just because they're on the internet.

As for what makes him a "douchebag" in my eyes is the lack of foresight on the marketing end. To me, no business sense = douchebag. Math being what it is, this is also the reason I'll never go into business with a Sparty fan, because douchebag therefore = no business sense.
